HomeMy WebLinkAboutReso 5876-1972RESOLUTION NO. 5876 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING PROPOSAL FOR INCLUSION IN A MEMORANDUM OF UN DE RS TAN DIN G. BE IT RESOLVED by the City Council of the City of South San Francisco that: ' WHEREAS, the City Council on June 19, 19 72, received a request from Mr. Frank Gillis, Council Director of Local 57, AFSCME, AFL-CIO, contained in a letter dated June 19, 1972, and in the oral presentation made at said meeting, and WHEREAS, the Council ordered a meet and confer session between City representatives and Mr. Gillis and other employee representatives which commenced on June 19, 19 72, in City Hall, South San Francisco, California, at approximately 10:00 p.m. and continued to 11:50 p.m. on said date and then adjourned to 8:30 a.m. June 20, 1972. The employer repre- sentatives submitted to the employee representatives the Proposal for Inclusion in a Memorandum of Understanding designated Exhibit A, attached hereto, and agreed to accept as an amendment the proposals contained in Exhibit B, attached hereto, with the understanding that the proposal and amend- ments would be presented to the employee members who were then meeting at Santo Cristo Hall, South San Francisco. The meet and confer session was then adjourned to 1:00 p.m., and WHEREAS, upon reconvening the meet and confer session at 1:06 p.m. Mr. Frank Gillis informed the employer representa- tives that the employees had rejected the proposal and as a result were willing to continue negotiations but had approved application to the Central Labor Council for strike sanctions, and WHEREAS, the employer representatives then met with the City Council of the City of South San Francisco at 1:40 p.m. to report the results of the meet and confer sessions with the employee representatives in attendance, and lo WHEREAS, the Council after due consideration desired to make the Proposal for Inclusion in a Memorandum of Understand- ing set forth in Exhibit A a continuing offer to mediate and to further offer to continue negotiations; NOW, THEREFORE, IT IS ORDERED THAT: 1. The City council of the City of South San Francisco holds open its offer to mediate as set forth in the Proposal for Inclusion in a Memorandum of Understanding, attached hereto as Exhibit A. 2. The City Council of the City of South San Francisco offers to continue negotiations. 3. The City Council authorizes the City Clerk to send a copy of this Resolution to Mr. Frank Gillis, Council Director of Local 57, AFSCME, AFL-CI0. Frank Mammlni and Warren STeink~mp None None ATTEST: ~~/~ ' City Clerk · lowing: and EXHIBIT A PROPOSAL FOR INCLUSION IN A MEMORANDUM OF UNDERSTANDING WHEREAS, the employee represen'tatives propose the fol- "The City of South San Francisco shall not contract or subcontract to any person, firm, partnership, corpora- tion, or combination thereof, any gervice or work tra- ditionally per= o . ~orm~d by employees of the City In addition, any new service provided to the citizenry by the City shall only be performed by employees hired by the City under the Personnel Rules and Regulations," WHEREAS, the City holds the opinion that it has the obligation to select the methods by which existing and new services are to be performed, including contracting or subcontracting and the hiring of employees pursuant to the Personnel Rules and Regula- tfons with the proviso that reasonable provisions be made regarding lay-offs, transfers or other acts affecting City employment, and WHEREAS, the employee and employer representatives are unable to agree at this time regarding said concepts and/or pro- visions and desire to explore and develop said concepts through the process of mediation as provided in Government Code Section 3505.2 with the mediation not being binding on either party until said concepts and provisions are mutually agreed upon and pending completion of said mediation no lay-offs will be made by City for the purpose of contracting or subcontracting with any person, firm, partnership, corporation or combination thereof for any service or work now performed by employees of the City; EXHIBIT A 1. i i Ill I Iii NOW, THEREFORE, IN CONSIDERATION OF THE AFOREGOING PREMISES, IT IS AGREED AS FOLLOWS' That the parties shall submit the matter contained in the recitals above to mediation pursuant to Government Code Section 3505.2.
