CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AUTHORIZING CITY NANAGER AND
DIRECTOR OF ECOLOGICAL DEVELOPNIENT TO
EXECUTE CONTRACT BETWEEN CITY OF SOUTH SAN
FRANCISCO AND REICHHOLD CHENICALS, INC.,
REQUIRING LATTER PARTY TO CONSTRUCT PRE-
TREATNENT PLANT AND FIX'lNG SEWER RENTAL CHARGES
WHEREAS, under Ordinance 396, Section 9, City of South San Francisco
may, upon a proper showing and upon the Clty Council's maki.ng a determination,
enter into a speclal written .agreement with any Industrial concern provldl,ng
for the direct payment of sewer rentals or charges to the City, and
WHEREAS, it is the poi Icy of the City of South San Franclsco to induce
Industrial enterprise to improve the quality of the aqueous waste discharged
Into this City's public sewer system, and
WHEREAS, those performance provisions embodled In "Exhlbit A" attached
hereto, would accomplish the above stated policy goal,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTH SAN FRANCISCO that this Councll authorizes the City Manager and the
Director of Ecological Development of thls Clty to execute the contractual
provisions as set out in "Exhibit A."

EXHIBIT A
CONTRACT FOR CONSTRUCTION OF
PRE-TREATblENT PLANT AND SEWER
RENTAL CHARGES BETWEEN CITY
OF SOUTH SAN FRANCISCO AND
REICHHOLD CHEMICALS, INC.
THIS AGREEMENT between the City of South San Francisco,
400 Grand Avenue, South San Francisco, and Reichhold Chemicals,
Inc., 120 South Linden Avenue, South San Francisco, is designed
to improve the quality of the ageous waste discharged by R.C.I.
to the City Sewer Treatment Plant.
I. R6ichhold Chemicals, Inc., agrees that'
(a) It will. design, let bids for, and construct a Pre-Treatment
Plant by December 31, 1972. The design of the Pre-Treat-
ment Plant is subject to review by the City of Sou~h San
Francisco.
{b) It will furnish a surety bond in the amount of Seventy-
six Thousand Nine Hundred Eighty Nine Dollars ($76,989.00)
as secdrity for payment of sewer rental charges assessed
by the City against Reichhold Chemicals, Inc., in accord-
ance with City Ordinance 396, 'as amended by City Ordinance
628; should failure in the performance of Paragraph I (a)
'result in additional sewer rental charges, the sewer
charges shall be in the amount' of Seventy-six Thousand

one hundred eighty-two (182) days for each day Reichhdld .
Chemicals, Inc., fails to meet effluent standards contained
in Ordinances 363 and 396, as amended by Ordinance 628, or

fails to comply with this agreement. Due date:for payment,

The surety bond shall be submitted to the City Clerk by
July 14, 1972..
(c) It shall comply with City Ordinances 363, 396 and 628

and shall cooperate with the City in studies for the
determination of, and abatement of R. C. I.'s
contribution to excessive industrial waste loading which
causes operating problems at the City IVaste Treatment
Facility and shall attempt to accomplish this end within
the time frame of this agreement.
It shall reduce BOD, water consumption, and
suspended solids to a combined level below that which
produces a fee equal to Twenty-five Thousand Dollars
($25,000.00) per City ordinances, or be responsible for
paying -the difference between said sum and any additional
assessment based on later tests.
II. City of South San Francisco agrees that'
(a) It will assess a sewer rental fee in the amount of
.Twenty-'five Thousand Dollars ($25,000.00) for the fiscal
.year 1972-75, said amount to be placed on the County tax
roll. In subsequent years, the sewer rental fee will be
'determined as per City ordinances.
(b) It will extend the date of completion beyond December 51,
1972, for a reasonable period/periods of time upo.n a
showing of good cause; however, the right of extension
shall be granted only in the event that Reichhold Chemi-
cals, Inc., requests such an extension in writing twenty

Director of Ecological Development, City of South San
Francisco, shall administer the provisions of this
contract.
