HomeMy WebLinkAboutReso 5907-1972RESOLUTION NO. 5907 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING CATV SUBSCRIBER RATE INCREASES AS OF SEPTEMBER 1, 1972. BE IT RESOLVED by the City Council of the City of South San Francisco that the Council, in a public hearing on the 7th day of August, 1972, due notice of which was given by publication on the 21st day of July, 1972, in the "Enterprise- Journal, a newspaper published and circulated in the City of South San Francisco (copy of which notice is attached hereto as Exhibit "A"), having considered the Western TV Cable's subscriber rate increase request dated June 30, 1972, with attached documents, copy of which is on file in the office of the City Clerk, and the report and recommendations of the staff, particularly the financial analysis by Ledwith, Chagaris g Co., Certified Public Accountants, for the City of South San Francisco, and the written and oral statements made at said hearing, finds and determines as follows: 1. The increase is cost justified and does not reflect future inflationary expectations. 2. The increase is the minimum required to assure con- tinued adequate and safe service or to provide the necessary expansion to meet future requirements. 3. The increase will achieve the minimum rate of return needed to attract capital at reasonable cost and not to impair the credit of the applicant. 4. The increase does not reflect labor costs in excess of those allowed bY the Price Commission policies. 5. The increase takes into account expected and obtain- able productivity gains as determined under the Price Commission policies. 6. The subscriber rates as set forth in Section 6 of Ordinance No. 563, passed June 19, 1967, should be reasonably increase d. 5 i ' ~ I "'T'IiT i~'1111 T NOW, THEREFORE, THE COUNCIL ORDERS THE FOLLOWING: 1. Subscriber rates now set forth in Section 6 of Ordinance 568 passed June 19, 1967, shall be increased as of SePtember 1 , 19 72, as follows: a. SinRle-use premises--individual subscriber (residential and commercial) The monthly service charge shall not exceed Four Dollars and Ninety-five Cents ($4.95) for the first single receiving set or apparatus and for each receiving set or apparatus in excess of one at the location of any such subscriber, a sum not to exceed One Dollar and Twenty-five Cents ($1.25) per month. b. Municipal and South San Francisco Unified School District There shall be no monthly service charge for service to the occupied municipal properties of the City of South San Francisco or the South San Francisco Unified School District within the corporate limits of the City. c. Hotels, motels, multiple dwellings, and other buildings The monthly service charge for hotels, motels, multiple dwellings, and other buildings as more par- ticularly described in Sectian 5C of Ordinance 563, shall not exceed Four Dollars and Ninety-five Cents ($4.95) for service to the antennaplex or other distribu- tion system and One Dollar and Twenty-five Cents ($1.25) monthly for each outlet from said antennaplex or other distribution system within the premises. d. FM monthly service charKe The monthly service charge for FM service to sub- scribers who have an FM terminal block installed as set forth in Section SE of Ordinance 563 shall not exceed One Dollar ($1.00) per month. · 2. The Council, being aware that additional requirements proposed by the Federal Communications Commission may establish a basis for further subscriber rate increases, declares its intention to review subscriber rates prior to September 1, 1973, for the purpose of determining whether such increases are warranted. The Council will consider all the factors related to subscriber rates including but not limited to cost of opera- tions, gross revenues, projected increase in number of sub- scribers, and the Federal Communications additional require- ments. If the Council determines that rate increases are war- ranted, said increases shall be limited to (1) a sum not to exceed Five Dollars and Twenty-five Cents ($5.25) for single- use premises as described in 1-a above, (2) a sum not to exceed Five Dollars and Twenty-five Cents ($5.25) for service to the antennaplex for subscribers described in 1-c above, and (3) a sum not to exceed One Dollar and Twenty-five Cents per month ($1.25) for FM service, as described in 1-d above. If the Council determines that a rate increase is not warranted, then the rates shall remain for 1973 as set forth in l-a, b, c and d above. If the Council determines that a rate reduction is war- ranted~ then the Council will establish a rate which assures fair compensation to the franchise grantees without excessive subscriber rates to subscribers. 3. The Council declares its intention to make a biennial review of subscriber rates commencing in the year 1974. Frank Mammini and Warren Steinkamp -- N OE S, " None ABSENT, " None ATTEST I EXHIBIT "A" RESOLUTION 5907 NOTICE OF HEARING PROPOSED CATV RATE INCREASE NOTICE IS HEREBY GIVEN that the City Council of the City of South San Francisco will hold a public hearing on August 7, 1972, at 8:00 P.M. in the Council Chambers, City Hall, 400 Grand AVenue, South San Francisco, California, for the purpose of con- sidering the CATV rate increases proposed by Western TV Cable, at which time and place any and all persons interested may be heard thereon. REFERENCE IS HEREBY MADE to the proposed rate increases and documents related thereto contained in the application dated June 30, 1972, copy of which is on file in the office of the City Clerk.and available for public inspection between the hours of 8:30 A.M. and 5:00 P.M. daily except Saturday and Sunday.
