A NEVADA CORPORA- 'TI'ON' '(PARCEL ADJACENT 'TO 'RAILROAD AVENUE ) BE IT RESOLVED by the City Council of the City of South San Francisco that the City Clerk be and he is hereby authorized to accept and record or cause recorda- tion of a Quitclaim Deed conveying to the City of South San Francisco the interest set forth in the Quitclaim Deed. Attached hereto is Exhibit "A". I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 5th day of September by the following vote: 197,:2 , AYES, COUNCILMEN Patrick E. Atkinson Company, a Nevada corporation, acquired from Utah Construction ~ Minin~ C.o. by Gra~.t Deed recorded October Z, 1970 in Official Records of San Mateo County Book page (Recorder's No. 50784AD) the following described property: That portion of the lands described in the Deed to the Southern Pacific Railroad Company recorded December 1, 1893 in Book 67 of Deeds at page Z1, Records of San N~[ateo County; being bounded on the Northwest by the Southeasterly line of Orange Avenue; bounded on the Northeast by the Southwesterly line of Railroad Avenue, bounded on the South- east by the Northwesterly line of Magnolia Avenue and bounded on the Southwest by the Northeasterly line of the lands described in the Deed to Guy t~. Atkinson Company, a corporation, dated November Z3, 1943 and recorded December 3, 1943 in Book 1103 Official Records of San Marco County, page 12 (99455-]2); subject to the rights of the grantee under said Deed recorded December 1, 1893 to use said property for railroad purposes only; and Whereas, by Certificate and Order of the Interstate Commerce Commission dated March 25, 1971 the said Commission granted to Southern Pacific Transportation Company the rig~ht to abandon the only railroad line on said property, said railroad line has been abandoned and Guy F. Atkinson Company has re-entered and taken possession of said property in accordance with said Deed recorded December 1, 1893; and Whereas, the City of South San Francisco has requested that a 10-foot strip of said property adjoining Railroad Avenue be conveyed to the City for the purpose of constructing a sidewalk and landscaping, except those portions used by Guy F. Atkinson Company for access to its property. Now,Therefore' Guy F. Atkinson Company, a Nevada corporation, hereby quitclaims to the City of South San Francisco, a municipal corporation: le A five-foot strip comprising the northerly five feet of said property immediately adjoining Railroad Avenue, resettling to Guy F. Atkin- son Company easements for access at the locations indicated as driveways on the attached Plat, marked Exhibit A; and A five-foot strip southerly of and immediately adjoining said five- foot strip, excepting those portions indicated as driveways on the .said Plat. Guy F. Atkinson Company shall have the right from time to time to relocate said driveways or to construct and use additional driveways and in .connection with such relocation or construction shall pay al2 costs in con- nection xvith removing, adding or replacing sidewalks and landscaping in order to maintain the plan of sidewalks and landscaping then in place.
