HomeMy WebLinkAboutReso 5957-1972 RESOLUTION NO. 5957 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO,STATE OF CALIFORNIA A RESOLUTIO~N AMENDING RESOLUTION N0.5423 AND RELATED RESOLUTIONS AUTHORIZING FILING OF APPLICATION FOR STATE AND INCREASED FEDERAL GRANT UNDER THE TERMS OF THE CLEAN WATER BOND LAW OF 1970 AND FEDERAL WATER POLLUTION CONTROL ACT ( SHAW ROAD PUMP STATION,ETC.) WHEREAS, City of South San Francisco (herein called the "Applicant",) after thorough consideration of the various aspects of~the problem and study of available data has hereby determined that the construction of certain public works, generally described as joint sewerage works to serve the cities of South San Francisco and San Bruno, to include.additions and enlargements to the Shaw Road sewage pumping plant and new force main, is desirable and in the public inter.est and to that end it is necessary that action preliminary to the construction of said works be taken immediately; and WHEREAS, under the terms of Public Law 89-5?3, the Federal Water Pollution Control Act (33 U.S.C. 466 et seq.) as amended, and related acts, the United States of America 'has authorized annual appropriations for grants to municipali- ties to aid in financing the cost of constructing or remodeling of sewage treatment works; and WHEREAS, the Clean Water. Bond Law of 1970 (Chapter 13, Division ?, of the Water Code) authorizes the State Water Resources Control Board to enter into contracts with municipali- ties to aid in the construction of eligible projects for the purpose of providing full participation by the State under the provisions of Section 8 of the Federal Water Pollution Control Act (33 U.S.C. 466 et seq.) and acts amendatory or supplementary thereto; and WHEREAS, the said State law provides that a state · I~ '~111 ' 'ITlll ] T Ill ! grant shall be for an amount which equals the minimum amount required by federal law for the project to qualify for the maximum amount of federal assistance available; and WHEREAS, the applicant has examined and duly considered the Clean Water Bond Law of 1970 and the Federal Water Pollution Control Act, and the applicant considers it to be in the public interest and to ±ts benefit to file an application under said law and act and to authorize other action in connection there- with; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco, the governing body of said applicant, as follows: 1. That the construction of said public works'is essential to and is to the best interests of the applicant, and to the end that such puhlic works may be provided as promptly as practicable it is desirable that action preliminary to the construction thereof be undertaken~immediately; that the Director of Public Works of the City of Somth San Francisco be hereby authorized to file and sign in behalf of the.applicant an "Application for a State and Increased Federal Grant for Sewage Treatment WORKS Under'Clean Water Bond. Law, 1970, and Federal Water Pollution Control Act" and to sign any and all documents in connection with State and Federal grants to aid in defraying the cost of the Shaw Road pumping station and new force main. ~2. The said Director of Public Works is hereby authorized to furnish such information and take such action as may be necessary to enable the applicant to qualify for the grants. 3. That said Director of Public Works is hereby designated as the authorized representative of' the applicant for the purpose of furnishing to the State of California and · "~*:'1~1 1 IIII1,' 'illl~ I il I1! Ill I ~ the United States such information, data and documents pertaining to the application for such grant as may be required; and to sign any and all related documents and otherwise to act as the authorized representative of the applicant in connection with this application.
