CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION REQUESTING THAT THE SAN MATEO
COUNTY FLOOD CONTROL DISTRICT ACQUIRE
RIGHTS OF WAY FOR COLMA CREEK IMPROVEMENT
INCLUDING STATE LANDS, PURSUANT TO WATER
CODE ACT 7261, SECTION 30.
BE IT RESOLVED by the City Council of the City of South
San Francisco that
1. The Council respectfully requests the San Mateo County
Flood Control District to determine the additional rights of
way needed for Colma Creek improvement and commence acquisition
thereof, and
2. The Council respectfully requests that the San Mateo
County Flood Control District .select .the parcel located at
the juncture of Colma Creek and South Airport Boulevard which
will be needed for the Colma Creek improvement and which is
described in Exhibit A attached hereto, said selection to be
accomplished pursuant to Section 30, Water Code Uncodified
Acts, Act 7261, which reads as follows:
30. Grant right of way over and across State public
lands: Purposes: Selection of right of way: Transmission
to State Lands Commission, etc., of plat of selected
lands: Approval of selection: Issuance of permit to
use right of way and lands
There is hereby granted to the San Mateo County Flood
Control District the right of way for the location,
construction and maintenance of flood control channels
ditches, waterways, conduits, canals, storm dikes,
embankments, and protective works in, over and across
public lands of the State of California, not other-
wise disposed of or in use, not in any case exceeding
in length or width that which is necessary for the
construction of such works and adjuncts or for the
protection thereof. Whenever any selection of a
right of way for such works or adjuncts thereto is
made by the district the board of supervisors thereof
must transmit to the State Lands Commission, the
Controller of the State and the recorder of the
county in which the selected lands are situated, a
plat of the lands so selected, giving the extent
thereof and the uses for which the same is claimed
or desired, duly verified to be correct. If the
State Lands Commission shall approve the selections
so made it shall endorse its 'approval upon the plat
and issue to the district a permit to use such right
of way and lands.
I hereby certify that the foregoing Resolution was
regularly introduced and adopted by the City Council of
the City of South San Francisco at a regular
meeting held on the 6th day of November
19 72 , by the following vote:

That certain property in the County of San Mateo,
State of California, the address which is west side of
Airport .Boulevard at Colma Creek, South San Francisco,
California, and legally described as:
THAT PORTION of that certain real property acquired
by State of California from South San Francisco Land
and Improvement Co., by Grant Deed No. 151, recorded
May 18, 1944, in Book 1107, Page 506, 0.R. of the
County of San Mateo; said portion being shown on the
map attached hereto and by this reference made a part hereof.

Reference: Resolution 59 76.
The referenced resolution designated officials to
sign checks and warrants and called for a bond.
Attached are applications to be completed by. the City
Manager, Director of Finance and Staff & Budget Assistant. Each
will have to complete lines 1, 2, 4, 16, 18 and the subscription
on the back of the form. I suggest that line 4, amount of bond,
be $1,000,000 and effective date be 12/1/72.
After completion the applications should be submitted
to Mr. A1 Baldi so that the bonds may be issued.

Forwarded herewith is the resolution in the above-
entitled matter which was passed November 6, 1972.
The resolution authorizes manual and/or plate signatures
by the Director of Finance and in his absence, or disability manual
signature by Staff and Budget Assistant, plus the manual or plate
signature by the City Manager.
The resolution requires a surety bond for each of the three
proposed signatories and requires that the bond be filed with you
prior to the issuance of checks or warrants by them. Pending receipt
of the bond, the checks or warrants should be issued as currently
auth ori zed.
