HomeMy WebLinkAboutReso 6014-1973RESOLUTION NO. .6014 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN 'FRANCISCO, STATE OF CALIFORNIA, REQUESTING REPAIR AND RESTORATION OF FLOOD CONTROL WORKS BY U. S. ARMY CORPS OF ENGINEERS UNDER PUBLIC LAW 99. WHEREAS, during the period commencing January 16, 1973, storms and flooding caused severe damage to flood control works on public and private lands in the City of South San Francisco; and WHEREAS, Public Law @@, 84th Congress, as amended (33 U.S.C.A. Section 701n), provides a means of repairing and restoring said flood control works; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the U. S. Army Corps of Engineers be and it is hereby requested to undertake the repair and restoration of flood control works on public and private lands in the City of South San Francisco which were destroyed by the flood or which are now threatened because of possible future flooding, such repair and restoration to be applicable to projects which are eligible under said Public Law 99. BE IT FURTHER RESOLVED that, in consideration of such repair and restoration, the City of South San Francisco, acting through its City Council, agrees to hold and save the United States and its servants, agents and employees free and harmless from any and all manner of actions, liability and claims to persons or property as a result of such repair and/or restoration work performed by the United States, its servants, agents and employees. BE IT FURTHER RESOLVED that the City of South San Francisco agrees to provide, without cost to the United States, all lands, easements and rights of way necessary for the authorized work. BE IT FURTHER RESOLVED that Gale F. Dreisbach, City Manager, and/or Fred W. Hull, Director of Public Works, be and each of them is hereby authorized to request the U. S. Army Corps of Engineers to perform and to specify the repair and restoration work which is generally described above and to certify to the U. S. ~Army Corps of Engineers that all lands, easements, and rights of way necessary for the prosecution of such work have been obtained by the City of South San Francisco. BE IT FURTHER RESOLVED that the City of South San Francisco agrees to maintain and operate in a manner satisfactory to the Chief of Engineers, all the repair and restoration work after completion, including the interrelated portions of the flood · control works not requiring repair or restoration. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a sl~ecial meeting held on the 19?h day of January , 19 75 , by the following vote: AYES, COUNCILMEN NOES, ABSENT: " Patrick E.
