HomeMy WebLinkAboutReso 6025-1973RESOLUTION NO. 6025 CITY COUNCIL, CITY OF SOUTH SAN FI:~ANCISCO, STATE OF CALIFORNIA A RESOLUTION OF THE CITY OF SOUTH SAN FRANCISCO DETERMINING UNITS WITHIN EMPLOYEE ORGANIZATIONS AND ESTABLISHING A PROCEDURE TO VERIFY THAT SUCH ORGANIZATION DOES REPRESENT EMPLOYEES OF THE CITY OF SOUTH SAN FRANCISCO, VERIFYING THE OFFICIAL STATUS OF THE EMPLOYEE ORGANIZATION, OFFICERS AND REPRESENTATIVES AND RECOGNIZING SUCH EMPLOYEE ORGANIZATIONS (Meyer-Mllas- Brown Act Sec. 3507) WHEREAS, the City of South San Francisco has received a request ,for recognition from employee organizations; and WHEREAS, the City Council recognizes and intends to fulfill its obligations under the Meyers-Mil las-Brown Act as amended in 1968 (Cal. Govt. Code, Sec. 3500-3511); and WHEREAS, said Act empowers the City Council to determine the appro- priate collective bargaining units of employees for representation and to verify the official status of an employee organization; NOW, THEREFORE, BE IT RESOLVED: I. The units hereinbelow described are declared and shall be the units of employees for any and all purposes relevant to the obligations of the City of South San Francisco under the aforesaid Meyers-Milias-Brown Act. Unit No. I contains management and confidential employees. Unit No. 2 contains professional. Unit No. 3 contains maintenance and field employees. Unit No. 4 contains office and clerical employees in all categories and departments. Unit No. 5 contains Police Officers. Unit No. 6 contains Fire Fighters. 2. The organization shall be recognized by the City of South San Francisco as the bargaining representative pursuant to Section 2. 103 of the Ordinance entitled: "An Ordinance of the City of South San Francisco Establishing a Procedure for the Formation of, Recognition of, and Communi- cation with Employee Organizations," for the purposes· of the M~yers-Milias- Brown Act in each or any of the above bargaining units in which it obtains a majority vote in that unit of the employees as provided in Paragraph 4-H. 3. Such vote of employees shall be conducted on a nn!t by unit basis · . and not on an aggregate or combined vote of all units.' 4. The election procedure as aforesaid shall be conducted under the direction ~f and according to procedures established by the City Manager subject to the following considerations: A. The voting will be held as announced by The Municipal Employee..~ Relations Officer. B. The voting shall be held at such times and places as Will cause, in the judgment of the City Manager, the least disruption · of the functions of the City offices and departments wh~le at the same time insuring maximum participation of the affected employees. C. Voting shall be performed on a ballot designated and provided by the City Manager which will clearly indicate to each employee his Opportunity to choose whether or not he wishes to b.e represented by an organization. D. Those employees eligible t° vote shall be regular, full-'' time,, or probationary employees on the payroll of the City of South San Francisco and actively working on the last payroll period immediately ~preceding the election. There will be no mail or absentee ballots. .. E. In each bargaining unit election, there will be a Staff and an Organization observer to insure that those who seek to vote are on the eligibility list for the .appropriate unit. F.Following the vote in each unit, the ballots will be courted jointly by the Staff and Organization representatives upon ~completion of which both and each will sign a certification ' document attesting to the tally of votees and~ the result of the election in that unit. G. As early as can be arranged following the election in each unit, the City Manager's Office will issue a memorandum to all employees in the units where elections have been held, advising the employees of the results of such election. H. In each unit, 60% of those eligible to vote must vote or the election will be declared invalid in that unit. I. The City will not consider or process any claim for recognition or conduct any election with' respect to any employee organization which has failed to obtain a majority in an election in any unit in which it has participated within the immediately preceding twelve (12) months. J. Run-off election will be conducted between two organizations where over 50% of.those voting cast a ballot favorable to a representative organization but no one organization receives a majority. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 20th day of February, 1973, by the following vote: AYES, COUNCILMEN Patrick E.
