HomeMy WebLinkAboutReso 6046-1973RESOLUTION NO. 6046 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING RELEASE OF ESCROW FUNDS PURSUANT TO RELEASE AND CONSENT OF WESTBOROUGH COUNTY WATER DISTRICT (UP-39 AND UP-S8). BE IT RESOLVED by the City Council of the City of South San Francisco that, Westborough County Water District having executed and filed a release and consent to release funds retained in escrow, as set forth in Exhibit A attached hereto, the City Council hereby authorizes the release to the parties entitled thereto of the $10,000.00 escrow deposit together with any accrued interest established in accordance with escrow instructions dated September 25, 1968, from the City Attorney to Title Insurance and Trust Company, Redwood City, California, in Escrows Numbers 388305 and 388308, Westborough Square, and the City Attorney be and he is hereby authorized to make, exe- cute and file any releases necessary to carry out the provisions of this resolution. I hereby certify that the foregoing resolution was regu- larly introduced and adopted by the City Council of the City of South San Francisco at a adjourned regularmeeting held on the 12 day of March , 19 73 , by the following vote: AYES, COUNCILMEN Patrick E. Ahem, William A. Borba, F. Frank Mammini and Warren Steinkamp N 0E S, " None ABSENT, " None ATTEST: ~ EXHIBIT A RELEASE AND CONSENT TO RELEASE FUNDS RETAINED IN ESCROW WHEREAS, the City of South San Francisco, a municipal corporation (hereinafter designated "City") required certain road improvements in Westborough Boulevard as the con'dition of a use permit, and WHEREAS, the Westborough County Water District, a public · corporation (hereinafter designated "District") claimed that said work of improvement caused damage and injuries to its properties and facilities, and WHEREAS, City required Title Insurance and Trust Company to retain funds of developers to secure the repair and· replacement of the claimed damaged property~and facilities should same be established, and WHEREAS, developers and District now have reached an accord regarding said claimed damage and desire to have City release the funds so retained in escrow by the Title Insurance and Trust Company. NOW, THEREFORE, the Westborough County Water District, a public corporation, hereby consents' to release of the Ten Thousand Dollars ($10,000.00) retained in Escrows Numbers 388305 and 388308, Title Insurance and Trust Company, Redwood City, CalifOrnia, by City to the parties entitled thereto, and does further release the City of South San Francisco, a municipal corporation, and its officers, agents and employees from any and all claims arising out of the occurrence set forth in District's claim dated July 18, 1969.
