HomeMy WebLinkAboutReso 6068-1973 RESOLUTION NO. 6068 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ORDERING THE VACATION OF A PORTION OF WILLOW AVENUE. BE IT RESOLVED by the City Council of the City of South San Francisco that this Council does hereby find, order and determine that: ' 1. City Council on the 12th day of February, 1973, adopted its Resolution No. 6024, entitled, "A Resolution of Intention to Vacate Willow Avenue Subject to Reservation of Certain Easements and to Vacate Certain Sanitary Sewer Ease- ments, and Setting of Public Hearing Regarding Said Vacation." 2. Said Resolution of Intention was duly published as required by law and Notices of Hearing were duly posted in the time, manner and form provided by law, all as appears from the Affidavit of Publication and the Affidavit of Post- ing on file in the office of the City Clerk of said City. 3. Monday, the 7th day of May, 1973, at the hour of 8:00 P.M. in the Council Chambers, City Hall, Grand and Maple Avenues, South San Francisco, California was fixed in said Resolution of Intention as the time and place when and where any and all persons interested in, or having any objection to, said proposed vacation may appear before said Council and be heard. 4. No objections of any kind or character have been, or were made or filed against said vacation. 5. The public interest, convenience and necessity require the vacation and abandonment of a portion of Willow Avenue and certain sanitary sewer easements over the portion of Willow Avenue and said sanitary sewer easements described as follows: A. Portion of Willow Road. Ail that certain real property situate in the City of South San Francisco, County of San Mateo, State of California, and more particularly described as follows: That certain strip of land 50 feet in width known as Willow Road formerly Ashton lying between Grand Avenue and Mission Road and bounded on the Southeast by the le Northwesterly line of that certain parcel of land described in Deed to Elizabeth C. Ashton, recorded April 30, 1887 in Volume 41 of Deeds at page 349, Records of San Mateo County, California; on the Northeast by the Southwesterly line of Grand Avenue; on the Southwest by the Northeast line of Mission Road and on the Northwest by the Southeast line of lands of County of San Mateo and described as Parcels III and IV in Deed recorded November 27, 1957 in Volume 3313 of Official Records at page 479, (File No. 511-Q), Records of San Mateo County, California; and by the Southeast line of lands of Oak Farm Inc. and described as Parcel I in Deed recorded September 1, 1959 in Volume 3665 of Official Records at page 32 (File No. 82981-R), Records of San Mateo County, California. B. Sanitary Sewer Easements. 1. An easement for sanitary sewers described as follows: Ail that certain real property situate in the City of South San Francisco, State of California, more particularly described as follows: An easement for sanitary sewer purposes for an existing sanitary sewer along the following described centerline: BEGINNING at a point in the southeasterly line of Willow Avenue (50 feet wide) (formerly Ashton Avenue) distant South 53° 15' West 545.88 feet and North 69° 15' West 259.90 feet from a granite monument on the northerly line of Grand Avenue, said monument desig- nated as "L-7" on the Map of Survey made for P. E. Iler, recorded March 10, 1891 in Book "E" of maps at page 79, Records of San Mateo County; THENCE from said Point of Beginning North 69° 15' West 94 feet and North 68° 45' West 290 feet. 2. An easement for sanitary sewers described as follows: Ail that certain real property situate in the City of South San Francisco, State of California, more particularly described as follows: An easement for sanitary sewer purposes for an exist- ing sanitary sewer along the following-described centerline: BEGINNING at a point distant South 53° 15' West 545.88 feet and North 69° 15' West 353.90 feet from a granite monument on the northerly line of Grand Avenue, said monument designated at "L-7" on the Map of Survey made for P. E. Iler, recorded March 10, 1891 in Book "E" of maps at page 79, Records of San Mateo County; THENCE from said Point of Beginning North 17° 00' East 75 feet. 6. The public interest, convenience and necessity require the reservation of easements and rights-of-way here- inafter set forth and the vacation proceedings are taken subject to such reservations and exceptions. The City does hereby reserve and except from the vacation and abandonment of said portion of Willow Avenue the following: · A. An easement for sanitary sewers described as follows: Ail that real property situate in the City of South San Francisco, State of California, described as follows: An easement for sanitary sewers 10 feet in width, being 5 feet on each side of the following described line: BEGINNING at a point in the southeasterly line of Willow Avenue (formerly Ashton Avenue), a 50 foot wide right-of-way, which point is distant along said line South 53° 15' West 155.96 feet from the angle point in said southeasterly line of Willow Avenue, said point of beginning also being the northwesterly terminus of the centerline of that certain easement granted to the City of South San Francisco by deed dated September 6, 1919, and recorded October 20, 1919, in Book 285 of Deeds at page 422, Official Records of San Mateo County; thence from said point of beginning North 45° 31'55" West 35.43 feet; thence North 53°15' East 147.5 feet and North 16° 17'12" East 75.6 feet more or less to the southwesterly line of Grand Avenue and the terminus of this 10 foot ease- ment. The side lines of said easement to be shortened or lengthened as necessary to provide continuity. B. An easement for sanitary sewers described as follows: Ail that certain real property situate in the City of South San Francisco, State of California, described as follows: An easement for sanitary sewers 10 feet in width, being 5 feet on each side of the following described line: BEGINNING at a point in the southeasterly line of Willow Avenue (formerly Ashton Avenue), a 50 foot wide right- of-way, said point being distant South 53°15' West 279.85 feet from the angle point in the southeasterly line of said Willow Avenue, said point also being distant South 53°15' West 545.88 feet and North 69°15' West 237.90 feet from a granite monument on the northerly line of Grand Avenue, said monument designated "L-7" on map of survey made for P. I. Iler, recorded Ma~rch 10, 1891, in Book "E" of Maps at page 79, Records of San Mateo County, said point also being at the northwest terminus of the centerline of that certain 10 foot wide easement de- scribed in deed recorded August 31, 1923 in Book 85 of Official Records at page 331, Records of San Mateo County; thence from said point of beginning North 69° 15' West 11.85 feet; thence North 36o45' West 40.00 feet to a point in the northwest line of said Willow Avenue (50 ft. wide) and the terminus of this easement. The side lines of said easement to be shortened or lengthened as necessary to provide continuity. 7. The City Clerk of said City shall cause a certified copy of this resolution and order, attested under the seal of said City, to be recorded in the office of the County Recorder of the County of San Mateo. · I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco au a regular meeting held on' the 7th day of May 19 73 , by the following vote: AYES, COUNCILMEN Patrick E.
