CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AUTHORIZING AN
ENCROACHMENT PERMIT -
FRANCISCO TERRACE.
BE IT RESOLVED by the City Council of the City of
South San Francisco that a revocable permit be issued in form
and substance substantially as set forth in Exhibit "A"
attached hereto for the use and fencing of the pathway adjacent
to 103 Francisco Drive.
I hereby certify that the foregoing Resolution was
regularly introduced and adopted by the City Council of the
City of South San Francisco at a regnlar meeting
he id on the 4th day of Jnne , 1973, by the

PURSUANT TO the authorization set ~."orth in Exl~ibit A
attached hereto (which exhibit is by -this reference incorporated
herein as if set forth verbatim), Permittees designated in said
exhibit are hereby granted permission t6 use the portio~ of the
right-of-way described in said exhibit for the purposes thePein'
set forth (hereinafter referred to as '.'improvement"). This revo-
cable permit is issued on the following terms and conditions:
1. City may revoke this permit by giving t~ermittees ninety
(90) days' written notice.
2. The installation of the improvement, mai~te~ance thereof
and removal, if same is required, shall be at Permittees' sole
cost and expense.
3. Permittees acknowledge title of :City' J.n and to said ease-
ment or right-of-way and agree never to assail o~.~ resist said title
or interest.
4. Permittees in using the easeme~t or r. igi~t-of-way area shall
in no way interfere with or limit City's rJ. gl~t 1_o make use of said
easement or right-o£-way area. CJ. ty reserves tt~e ~ight to enter'
upon said premises for use, inspection or maintenance of said ease-
ment or right-of-way area and Permittees shall_ bear the cost of

improvement in such a manner as not to damage City or public

maintain the improvement in a good and safe condition.
6. Permittees hereby agree to and do ]~old City, its elective
and~appointive boards, officers, agents and employees harmless .from
any liability or damage or claims for damage for personal injury
including death, as well as for Claims for prop~-~.rty damage caused
by the use of said r~[ght-of-way or easement area for 't]~e construc-
tion, maintenance and use of said improvement. Permittees agree
to and shall defend City, its elective and appo.il.~l:J.:ve boards,
officers, agents and employees from any suits or.' ~ctions at' law
or in equity for damages caused, or alleged -to have been caused, by
reason of the proposed use of said easement area..
7. This permit to use said right-of,-way o~ ease~nent area is
made to the extent t]1at the City has the power' o~' authority to
grant it, and should termination of the use be required by action
of the City as hereinbefore set forth, or o't]~e~'wise, Permittees
shall have no claim for loss or damage against tt~e City, its offi-
cers or employees.
