HomeMy WebLinkAboutReso 6191-1973RESOLUTIOn NO. 6191 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION CONCURRING WITH RESOLUTION NO. 2134 OF THE PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO SETTING ASIDE THE DECISION DATED MARCH 26, 1973, AND THE INTERPRETATIVE RULING THEREBY ADOPTED REGARDING USE PERMIT NO. 203 WHEREAS, the City Council of the City of South San Francisco meeting in regular session on Monday, October 15, 1973,duly considered the peremptory writ of mandamus issued by the Superior Court of the State of California in and for the County of San Mateo, Case No. 176292, entitled "Texaco Inc., et al v. City of South San Francisco, et al" wherein said Court ordered that the Planning Commission's decision dated 'March 26, 1973, and the City Council decision dated April 16, 1973, be set aside; and WHEREAS, the South San Francisco Planning Commission meeting in regular session on Tuesday, October 9, 1973, in its Resolution No. 2134, so ordered that the Planning Commission% decision dated March 26, 1973, and the interpretative ruling thereby adopted which is contained in the document dated March 27, 1973, be vacated and set aside as of October 9, 1973; and WHEREAS, the City Council of the City of South San FrancisCo desires to concur' in said Planning Commission's Resolution,and further order that the City Council's decision dated April 16, 1973, be vacated and set aside; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that said City Council does hereby concur with Resolution No. 2134 of the Planning Commission of the City of South San Francisco passed October 9, 1973, entitled "A Resolution of the Planning Commission of the City of South San Francisco vacating and Setting Aside the Decision dated March 26, 1973, and the Interpretative Ruling Thereby Adopted Regarding Use Permit No. 203",-and does further vacate and ~set aside as of this date the City Council decision dated April 16, 19.73, related thereto. City of South San Francisco at a held on the 15th day of October I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the regular meeting , 1973, by the following vote: AYES, COUNCILMEN NOES, " ABSENT," Patrick E.
