I TO THE MEMORANDUM OF UNDERSTANDING WITH UNIT NO. I BE IT RESOLVED By the City Council of the City of South San Francisco that Amendment No. I to the Memorandum of Und'erstanding for fiscal' years 1973-74 and 1974-75 with Unit No. I having been entered into between the employer represen- tativesand employee representatives, and having been duly considered by the Council, the' Council does hereby approve said Amendment No. I for fiscal years 1973-74 and 1974-75, a copy of which is attachedlhereto as Exhibit "A". Frank' Mammini, Terry J, M[rri and Warren SteinRmmp NOES, ABSENT, None None ATTEST' AMENDMENT NO. 1 MEMORANDUM OF UNDERSTANDING UNIT NO. 1 WAGE COMMITTEE 1973-74 WHEREAS, City's employees' representative and Unit No. 1 Wage Committee ~'have met and conferred in good faith regarding an amendment of Paragraph "2" of the Memorandum of Understanding for Unit No. 1 dated the 5th day of September, 1973, and agreed to present .same for acceptance and approval, and WHEREAS, the purpose of said amendment is to provide an alternate benefit to proposed members of Unit N°. 1, referred to as Chief of Police, Captains of Police and Lieutenants; NOW, THEREFORE, IN CONSIDERATION OF THE AFOREGOING PREMISES AND THE MUTUAL COVEN.ANTS HEREIN CONTAINED, IT IS AGREED AS FOLLOWS: · 1. Amendment of Paragraph "2" of the Memorandum of Understanding Dated September 5, 1973. Paragraph "2" of the Memorandum of Understanding dated September 5, 1973, shall be amended to read as follows: 2. RETIREMENT PLAN: A. Miscellaneous and Fire Department Members: The retirement plan for all members in Unit No. 1, except Chief of pOlice, Police Captains and Police Lieutenants and other local safety (Police) members as defined by PERS included in Unit No. 1, shall be modified effective January 1, 1974, so that a member on retirement shall be entitled to "Sur- vivor's Continuance" (referred to as 1/2 survivor's benefit), which entitles a member to his retirement --1, -- B, allowance not adjusted or reduced because of con- tinuence of one-half of said allowance (or applicable amount fop those members under the plan integrat.ed with Social Security) to his survivor. Local Safety (Police) Members of Unit N'o. 1: If Salvatore Rosano, James Datzman, James Swinfard, Raymond McKeon, David Casey, Theodore Silvas or Edward Scanzio during membership in Unit No. 1, retire (Service or Disability) 'as Chief of Police, Captain of Police, or Lieutenant of Police, and elect P.E.R.S. options 2, 3 or 4, the City shall determine the difference between said retiree's monthly r.etire- ment allowance paid by P.E.R.S. and the allowance which would have been paid if the survivor's contin- uance modification (Government Code Sec. 21263) had been effective and pay said difference to-said retiree monthly. If a Unit modification is made which effects a transfer of any or all of the named persons to another Unit, 'the named person or pepsons so tpans- ferred shall retain the benefit herein provided until' wage nego-tiations then pending for said Unit to which transfer is'made have been completed, and in the event no such wage negotiations are pending, then the -2- benefit shall be retained until the next succeeding wage negotiation for said Unit has been completed. If the survivor's continuance modification is made effective for the Police Department., or the named persons otherwise become subject to the survivor's continuance modification, City's obligation to pay monthly difference as hereinbefore recited shall terminate.
