HomeMy WebLinkAboutReso 88-1974RESOLUTION NO. 88-74 CITY COUNCIL, C~TY OF SOUTH SAN FRANCISCO,STATE OF CALIFORNIA A RESOLUTION SUBMITTING APPLICATION TO THE STATE OF CALIFORNIA DEPARTMENT OF NAVIGATION AND OCEAN DEVELOPMENT FOR A LOAN TO EXPAND A RECREATIONAL SMALL CRAFT HARBOR IN THE CITY OF SOUTH SAN FRANCISCO, CALIFORNIA BE IT RESOLVED by the City Council of the City of South San' Francisco that: WHEREAS, the City Council has heretofore employed the firm of Williams-Kuebelbeck and Associates, Inc.,assisted by Koebig and Koebig and Berlogar, Long and Associates, to prepare an engineering-economic feasibility study for expansion of the small craft harbor at Oyster Point Marina on lands owned or controlled by the City; WHEREAS, the City Council herewith finds that there is a need for the expansion of said small craft harbor; that said expansion is economically feasible and that it is in the best interest of the people of the City of South San Francisco that said small craft harbor be expanded at the earliest possible date in accordance with the said plan or said plan as modified and concurred in by the Department of Navigation and Ocean Development and District. NOW, THEREFORE, BE IT FOUND, ORDERED AND DETERMINED by the City Council Of the City of South San Francisco, as follows: 1. That the engineering-economic feasibility study entitled Oyster Point Marina Expansion Feasibility Study presented to the City Council of the City of South San Francisco by Williams-Kuebelbeck and Associates, Inc., be · I [~ 'Il [ TiIIIII ' and the same is hereby received as setting forth appropriate plans for the' expansion of the small craft harbor at Oyster Point Marina in the City of South San Francisco. 2. That the City Council herewith approves this application to the State of California Department of Naviga- tion and 0cean'Development for a loan in the sum of FIVE MILLION NINE HUNDRED NINETY THREE THOUSAND TWo HUNDRED DOLLARS ($ 5,993,200.00 ) to be funded 3 years . 3. That the City Manager of the City of South San Francisco be and he is hereby designated as the representative of said City and City Council and is hereby duly authorized to act on behalf of the said City and City Council subsequent to Council's approval relative to said loan'application. 4. That if the said loan is granted to the City of South San Francisco, the same will be used for the purpose of prosecuting the expansion of said small craft harbor diIigently to completion, and that when completed the same will be made available and open to all persons on equal and reasonable terms in accord with the requirements of the California Department of Navigation and Ocean Development and Harbor and Navigation Code. 5. That the said construction loan shall be secured by the gross rewenues of said small craft harbor (as expanded) of the City of South San Francisco known as the Oyster Point Marina, and that such gross revenues shall constitute security for such payment of said loan in accord with the California Harbors and Navigation Code. Gross revenues of said harbor include all charges received from, and all other income and receipts derived by the City from the operation of said Oyster Point Marina. Gross revenues include any income received by the City from any concession or other contract operations had by City on its harbor facilities, but does not include gross revenues to a con- cessioner, all in accord wi~h Article 3, commencing with , Section 70, et seq. of the California Harbors and Navigation Code. o% I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular · meeting held on the 6th day of May , 1974, by the following vote' AYES, COUNCILMEN Richard A.
