A RESOLUTION AUTHORIZING THE DEPARTMENT OF
PUBLIC SERVICES TO SUBMIT REQUEST TO THE
PUBLIC UTILITIES COMMISSION OF THE STATE
OF CALIFORNIA FOR ALLOCATIONS FROM THE
STATE CROSSING PROTECTION FUND
WHEREAS', the 1953 California Legislature by Statutes
1953, Chapter 1739, created a fund to assist lOcal agencies in
paying their share of the cost of constructing automatic pro-
tection at grade crossings of railroads and City or County
streets or highways; and
WHEREAS, the 1961 California Legislature by Statutes
1961, Chapter 1302, codified the provision as Section 1231 of
the Public Utilities Code; and
WHEREAS, Decision No. 49565 of the Public Utilities
Commission established a procedure for the submission of
requests' to the Commission for allocation from the State Cross-
ing Protection Construction Fund, which requires that the
legislative body of the local agency authorize filing of the
request; and
WHEREAS, the City Council desires to authorize submis--
sion of a request for allocations from the State Crossing
,
Protection Construction Fund for the construction of the
Kimball Way railroad crossing; and
WHEREAS, the obtaining of the City Council's action
for each individual crossing improvement to authorize the
submission of the request increases administrative costs and
delays filing for an allocation, and the City Council desires
to provide authorization by way of this Resolution for future
req ues ts;
NOW, THEREFORE, BE IT RESOLVED:
1. That the Department of Public Services of the City
of South San Francisco be authorized to prepare and submit to
the Pub.lic Utilities Commission of the State of California a
reques.t for allocations from the State Crossing Protection
Construction Fund pursuant to Section 1231 of the Public
Utilities Code for the construction of the. Kimball Way Railroad
crossing.
2. That the Departmen~ of Public Services of the City
of South San Francisco be aui;horized to prepare and submit to
the Public Utilities Commission of the State of California
for the City of South San FranciSco future requests for crossing
protection improvements from the State Crossing Protection
Construction Fund pursuant to Section 1231 of the Public
Utilies Code.

introduced and adopted by the City Council of the City of South
San Francisco at a reqular meeting held on the 2or. h day of
