I FROM UNIT NO. 5 AND AMENDMENT NO. 3 TO THE MEMORANDUM OF UNDERSTANDING WITH UNIT NO. 1. BE IT RESOLVED by the City Council of the City of South San Francisco that: 1. The Council, having duly considered the findings .and recom- mendations transmitted by the Municipal Employees Relations Officer regarding the transfers from Unit No. 5 to Unit No. 1, does hereby approve and confirm said transfers. 2. The Council, having duly considered the Amendment No. 3 to the Memorandum of Understanding with Unit No. I for Fiscal Years 1973-74 and 1974-75, entered into between the employer representa- tives and the employee representatives, does hereby approve said Amendment No. 3, a copy of which is attached hereto as Exhibit "A." I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 5th day of Februar~ , 19 75 , by the following vote: AYES, COUNCILMEN Richard A. Mirri, Leo Padreddii and Warren Steinkamp NOES, " None ABSENI, " None ATTEST · ~--~ ~//~~__/..~-~_~' City ClerR EXHIBIT A TO RESOLUTION 15-75 AMENDMENT NO. 3 MEMORANDUM OF UNDERSTAblDING UNIT NO. 1 WAGE COMMITTEE 1973-75 WHEREAS, City's Employer's Representative and Unit No. 1 Wage Committee have met and conferred in good faith regarding an amendment of paragraph "2" of the Memorandum of Understanding for Unit~ No. 1 dated the 5th day of September, 1973, as amended, and agreed to present same for acceptance and approval, and WHEREAS, the purpose of said 'amendment is'to provide an alternate benefit to proposed members of Unit No. 1, referred 'to as Police Sergeants; NOW, THEREFORE, IN CONSIDERATION OF-THE AFOREGOING PREMISES AND THE MUTUAL COVENANTS HEREIN CONTAINED, IT IS AGREED AS FOLLOWS: 1. AMENDMENT OF PARAGRAPH "2" .OF THE MEMORANDUM OF UNDERSTANDING DATED SEPTEMBER 5, 1973, AS AMENDED. Paragraph "2" of the Memorandum of Understanding dated September 5, 1973, as amended, is hereby further amended by adding thereto subparagraph C which shall read as follows: C. Local Safety (Police) Members of Unit' No. 1: If any of the following persons, Bernard'Esparza, Gus J. Nicolopulos, Joseph E. Simpson, Laurence A. Crafford, Norman F. Solari, George A. Baptista, James E'. Kuskie, Ronald L. Pe'trocchi, An'thorny E. Smith and Michael Morello during membership in Unit Iqo. ]., shall retir'e (service or disability) as Police Sergeant, Police Cap'tain, Police Lieutenant or Chief of Police, and elect P.E.R.S. options -- 1 2, 3 or 4, the City shall determine the difference between said retiree's monthly retirement allowance paid by P.E.R.S. and the allowance which would have been paid if the sur- vivor's continuance modification (Gov. Code Sec. 21263) had been effective and pay said difference to said retiree monthly. If a unit modification is made which effects a transfer of any or all of the named persons to another unit from Unit No. 1, the named person or persons so transferred shall retain the benefit here±n provided until wage negotiations then pend- ing for said unit to which -transfer is made have been com- pleted, and in-the event no such wage negotiations are pend- ing, then -the benefit shall be retained until the next suc- ceeding wage negotiation for said unit has been completed.. If the survivor's continuance modification (Gov. Code Sec. 21263) is made effective for the Police Department, or the named persons otherwise become subject to the survivor's continuance modification, City's obligation to pay monthly difference as hereinbefore recited shall terminate. 2. AMENDMENT ADDING PARAGRAPH 13. The Memorandum of Understanding dated September 5, 1973, is hereby amended by adding'thereto paragraph 13 which shall read as'follows: ~ 13. Health and Dental Plan Premium Adjustments. The portion of premium payments for health and dental 'plans paid by those named in subsection 2C, set forth above sinc~ January 1, 19'/$, shall be refunded except for Michael Morello for wl~om the reffund st~all be from the day of , 1975. 3. CONSENT TO TRANSFERS. · The Employees' representatives of Unit No. 1 approve 'the transfers of the persons named in paragraph 2-C above from Un'it No. $ Zo Unit No. 1.' ....
