HomeMy WebLinkAboutReso 149-1975 RESOLUTION NO. 149-75 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO,STATE OF CALIFORNIA A RESOLUTION AUTHORIZING THE EXECUTION OF CITY OF SOUTH SAN FRANCISCO'S CONTRACT FOR SERVICES WITH LEONARD S. MOSIAS AND ASSOCIATES TO CONDUCT A "LIMITED EXTERIOR PROPERTY SURVEY" OF ALL MAIN RESIDENTAL BUILDINGS IN A PROJECT AREA SHOWN AND DESCRIBED IN SAID CONTRACT AS EXHIBIT "A" BE IT RESOLVED by the City Council of the City of South San Francisco that execution of the contract for services between Leonard S. Mosias and Associates and the City of South San Francisco, a municipal corporation, a copy of which is attached hereto as Exhibit "C", is hereby authorized, and the City Manager is authorized to execute said contract for services on behalf of the City, and the City Clerk attest his signature thereto. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 17th day of september , 1975, by the following vote: AYES, COUNCILMEN Richard A. A. & ASSOCIATES EXHIBIT "C" CONTRACT FOR SERVICES THIS CONTRACT entered into this day of 1975 by and between the CITY OF SOUTH SAN FRANCISCO, CALI~0RNIA, (hereinafter referred to as the "Agency"), and LEONARD S. MOSIAS P ASSOCIATES, a California Corporation doing business as Leonard S. Mosias ~ Associates at 1800 Noriega Street,. San Francisco, California, (hereinafter referred to as the "Contractor")-, W I T N E S S E T H: WHEREAS, the Agency is undertaking certain activities necessary for the planning of future programs in the Project Area, as' illustrated in the Project Area Map attached hereto and labelled Exhibit "A"; and · WHEREAS, the Agency desires to engage the Contractor to render certain technical advice and assistance in connection with undertakings of the Agency; and WHEREAS, the Contractor represents that it is qualified to perform such services under the contract, NOW, THEREFORE, the parties hereto mutually agree as follows: 1. PROJECT AREA The Contractor shall perform all the necessary services in connection with and respecting .the project area, which includes' all residential real property located in the Project Area shown and described on Exhibit "Au. 2. OBLIGATIONS OF CONTRACTOR Contractor shall do, perform, and carry out, in.a satisfactory and proper manner, the following: (a) Conduct a limited exterior inspection of all main residential buildings - (approximately' .J~ structures). in said Project Area. (b) Fill out, for each building inspected, the form entitled, "Limited Exterior Property SurYey" attached hereto as Exhibit "B" and submit one (1) typed copy to the Agency. · ,~rc,ide Project Area map indicating. 1. Blocks, parcels and streets. 2. BlOck and parcel numbers. 3. Outlines of main and accessory structures on each parcel. 4. Fenalty point classification for each main building. Furnish original and six (6) copies t° the Agency. (d)' FurniSh six (6) signed copies' of. a summary report indicating: 1. Description of the Area. 2. Objectives of the Survey· . Scope of Survey. :4.. Field examination and methods used. . Criteria. . Findings. Recapitulation. · . Future programs recommendations. All records established by the Contractor upon this contract shall be delivered to' the Agency upon completion of the contract. . OBLIGATIONS OF THE AGENCY - . The Agency shall provide the following: (a) Sufficient copies of Survey form. (b) ~ps indicating block and parcel numbers and parcel dimensions. ..... -: ::(C)': 'AVailable:maps indicating outline of structures.: (d) Other data in the Agency's possession pertinent to the satisfactory completion of the servi~s. TIME OF .P_ERF0~XSiNCE. The services of the' Contractor are to commence no later than seven (7) days after the execution of this contract and sPa!l be undertaken and completed in such sequence as to assure the expedi- tious completion in the light of the purposes of this ¢on~rac'a within thirty (30) consecutive calendar days -ohereafter. . COMPENSATION AND METHOD OF PAYMENT - The Agency shall pay the Contractor, upon Satis- factory completion of the Services described herein the amount of three ($3.00) Dollars for each main building surveyed in full and complete satisfaction for Cent-factor's services required by sub-paragraphs. 2 (a) - (d) inclusive. (b) It is expressly understood that in no event will the. total compensation and reimbursement to be paid under this contract exceed the maximum sum of Four Thousand Four Hundred Seventy ($4,470.00) Dollars. 6. CONTRACTORS LIABILITY AND INSURANCE REOUIRE.~ENTS The Contractor shall be responsible for all injuries to persons and for all damages to the~inspected property caused by or result- ing from' the negligence of-himself,. 'his employees or agents during the progress or connected with the prosecution of the work within the limits of the work or elsewhere and shall hold the Agency harm- less and shall defend the Agency against any and all claims arising from such injuries or damages. Contractor shall car. fy Workmen~s Compensation insurance as required by Law and public liability insurance with such insurance company or companies and in such amounts as are satisfactory to the Agency. A certificate issued by the insurance carrier showing such policies to be in force for the period covered by the work herein contemplated shall be delivered to the Agency prior to the .commencement of work under this co~tract. Said certificate must - show that ten (10) days written notice shall be given to the Agency before cancellation thereof. Should any policy be cancelled before completion of the ·work herein contemplated and the Contractor fails to immediately procure other' insurance as herein required, the Agency may procure such insurance and deduct the cost thereof from the amount due the Contractor. IN WITNESS WHEREOF, the Agency and the Contractor have executed this agreement as of the date first above written.
