HomeMy WebLinkAboutReso 173-1975 RESOLUTION NO. 173-75 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO ORDERING REMOVAL OF WEEDS FROM PARCELS OF PRIVATE PROPERTY AND PUBLIC PLACES. WHEREAS, the City Council of the City of South San Francisco did on the 15th day of October, 1975, adopt its Resolution No. 161-75 in which said City Council determined that: weeds which will attain such a large growth as to become a fire menace when dry or which are otherwise noxious and dangerous, were growing'' upon private property, in said City, and declared that said weeds must be removed from the public streets, sidewalks and vacant and unimproved property in the City of South San Francisco as described by lot and block number in Appendix "A" to this resolution, which is hereby referred to and made part of this Resolution by said reference as if set forth herein verbatim; the cost and expense of sUch removal shall be assessed upon all lots of land upon which such weeds exist, and,in said Resolution,set Wednesday, the 5th day of November, 1975, at the hour of 7:30 p.m., in the West Orange Avenue Library (in the room known as the AuditoPium), 840 West Orange Avenue, South San Francisco, California, as the time and place when and where all persons having any objections to the proposed removal of said weeds may appear before said City Council and show cause why the work of the proposed removal of weeds should not be carried out, and i · WHEREAS, said Resolution No. 161-75 was duly published twice in the Enterprise-Journal, a newspaper published and circulated in the City of South San Francisco, and Notice to Destroy Weeds and of Hearing Regarding Order of Abatement was (1) mailed to each person to whom such described property is assessed in the last equalized assessment roll on the date said Resolution was adopted by the City Council, and (2) duly posted on the respect- ive parcels, and affidavits of publication, posting and mailing thereof are on file in the office of the City Clerk~and WHEREAS, the City Council at the time stated in said Resolu- tion No. 161-75 and said Notice, did hear and consider all objec- tions to the proposed removal of weeds, and thereafter concluded said hearing, NOW, THEREFORE, BE IT RESOLVED BY the City Council of the City of South San Francisco that: 1. Any and all protest and objections to the removal of said weeds are hereby overruled; 2. The Director of Public Services, ex officio Superintendent of Streets, shall: (a) Abate the nuisance caused by said weeds by having same removed from all the parcels described in Exhibit "A" attached hereto, and by this reference incorporated herein, except from those parcels from which said weeds have been removed prior to the undertaking of such re- moval pursuant to this Resolution, by the Director of · Public Services or his authorized representative or contractor; (b) Abate the nuisance by having the work performed by City forces and equipment or by contract awarded to the lowest responsible bidder; (c) Keep an account of the cost and expense of abat- ing such nuisance from each of the described parcels when the work is done by him, his representative or contractor, and render an itemized report in writing to the City Council showing the cost and expense of removing such weeds on and in front of each separate parcel, and ten (10) days prior to submitting said report to the City Council, file a copy of said report with the City Clerk, posting a copy of said report on the bulletin board in City Hall, and the door of the Council meeting room, with notice to the owners of the respective parcels, by mail, of the time when said report will be submitted to the City Council for confirmation. The notice of submission shall advise the owners of the parcels as to the time and place when and where any persons inter- ested in the work of removal or having objection thereto may be heard by the City Council. (d) File an affidavit with the City Clerk verifying the posting and mailing of the notice of submission and the report as hereinbefore described. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a re~;a~ meeting held this 5th day of November , 1975, by the following vote: AYES, COUNCILMEN Richard A.
