HomeMy WebLinkAboutReso 25-1976 RESOLUTION NO. 25-76 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING THE EXECUTION OF CITY OF SOUTH SAN FRANCISCO'S AGREEMENT WITH THE INFORMATION AND REFERRAL COMMUNITY SERVICES CENTER FOR SERVICES IN HO'USING AND COMMUNITY DEVELOPMENT, AS DESCRIBED IN SAID AGREEMENT BE IT RESOLVED by the City Council of the City of South San Francisco that execution of the agreement for services between the Information and Referral Community Services Center and the City of South San Francisco, a municipal corporation, a copy of which is attached hereto as'Exhibit "A", is hereby authorized, and the City Manager is authorized to execute said agreement for services on behalf of the City, and the City Clerk attest his signature thereto. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a reqular meeting held on the 25th day of Februarq , 1976 , by the following vote: AYES, COUNCILMEN Richard A. Mirri, Leo Padreddii and Warren Steinkamp NOES, " None ABSENT," None City Clerk AGREEMENT BETWEEN THE CITY OF SOUTH SAN FRANCISCO AND THE INFORMATION AND REFERRAL COMMUNITY SERVICES CENTER FOR SERVICES IN HOUSING AND COMMUNITY DEVELOPMENT EXHIBIT "A" TO RESO. NO. 25-76 THIS AGREEMENT, made this day of , 1976, by and between the ~-' CITY OF SOUTH SAN FRANCISCO, a municipal corporation, hereinafter referred to as the "City," and the INFORMATION AND REFERRAL COMMUNITY SERVICES CENTER,. a tax exempt non-profit public supported corporation, hereinafter referred to as "Center." WITNESSETH: WHEREAS, the Center has the Personnel and facilities to perform necessary services for the City; and WHEREAS, the City desires to obtain these necessary services from the Center in the area of housing and community development, pursuant to the terms and conditions hereinafter set forth. NOW, THEREFORE, IT IS HEREBY AGREED as follows: 1. Maintenance of Physical Facilities for Operations. The Center shall maintain an office facility for conducting its services at 291 Hillside Boulevard, South San Francisco, or such other place acceptable to the City. 2. Services Provided. The Center shall provide the following services: a. A survey of community development needs in the City's lower income areas (target area), including needs for physical improvements, economic opportunities, and social services. b. A survey of housing needs and services in the City,s target area. c. A survey of social services resources to be used as part of the City's Social Services element of the General Plan. d. Assist the City in implementing the Housing Assis- tance Plan in South San Francisco by: 1. assisting in identifying and counseling qualified low-income households eligible AGREEMENT, South San Francisco/ Information and Referral Center, cont'd Page 2 for the Section 8 federally assisted housing programs in South San Francisco; and 2. referrin§ qualified households to the San Mateo County Housing Authority for certification in the Section 8 program and providing language translation services when required. e. Disseminating information to the community on the Section 8 federally assisted housing program and on the City's housing program to be funded by Housing and Community Development Act (HCDA) funds. f. Schedule and arrange meetings for continued citizen participation in the City's HCDA Program. g. Provide housing placement services for meeting immediate housing problems confronting citizens of the City. h. Maintain information library which includes informa- tive brochures and technical publications to be distributed and/or utilized in attempts to acquaint residents with housing resources/programs and assist residents of the City in interpreting various program policies. 3. Emj~loyment_ Opportunities for Lower Income Persons and Local Busi,nesse.s. _i.n ~the C. ity of South San Francisco. The services to be provided under this agreement are subject to the following' -.Information and Referral Center, cont'd Page 3 a, The work to be performed under this agreement is on a project assisted under a program providing direct Federal financial assistance from the Department of Housing and Urban Development and is subject to the requirements of Section 3 of the Housing and Urban DeveloPment Act of 1968, as amended, 12 U.S.¢. 1701u. Section 3 requires that to the greatest extent feasible opportunities for training and employment be given lower income resi- dents of the project area and contracts, for work in connection with the project be awarded to business concerns which are located in or owned in substantial part by persons residing in the area of the project. · b. The parties to this agreement will comply with the provisions of said Section 3 and the regulations issued pursuant thereto by the Secretary of Housing and Urban Development set forth in 24 CFR Part 135, and all applicable rules and orders of the Department issued thereUnder prior to the execution of this agreement. The parties to this agreement certify and agree that they are under no contractual or other dis- ability which would prevent them from complying with these requirements. c. The Center will send to each labor organization or representative of workers with which he has a collective bargaining agreement or other contract or understanding, if any, a notice advising the said labor organization or workers' representative of his commitments under this .............. The Center will include this Section 3 clause in every subcontract for work in connection with the project and will, at the direction of the appli- cant for or recipient of Federal financial assis- tance, take appropriate action pursuant to the subcontract upon a finding that the subcontractor is in violation of regulations issued by the Secretary of Housing and Urban Development, 24 CFR Part 135. The Center will not subcontract with any subcontractor where it has notice or knowledge that the latter has been found in violation of regulations under 24 CFR Part 135 and will not let any subcontract unless the subcontractor has first provided it with a preliminary statement of ability to comply with the requirements ' of these regulations. e. Compliance with the provisions of Section 3, the regu- lations set forth in 24 CFR Part 135, and all applicable rules and orders of the Department issued thereunder priOr to the execution of the contract, shall be a condition of the Federal financial assistance provided to the project, binding upon the applicant or recipient for such assistance, its successors, and assigns. Failure to fulfill these requirements shall subject the applicant or recipient, its contractors and subcontractors, its ....... ,-,-,,,~ ~,~ u~ ou~ ~II francisco/ Information and Referral .Center,. cont' d Page 5 successors, and ~assigns to those sanctions specified by the grant or loan agreement or contract through which Federal assistance is provided, and to such sanctions as are specified by 24 CFR Part 135. 4. Term. and Termination of the Agreement. The term of this agree- ment shall be from the day of_ , 19. j , and said period may be reasonably extended by agreement of the parties. If for any cause either party fails to fulfill in a timely and proper manner its obligations under this agreement or violates any of the covenants, agreements or stipulations of this agreement, the non-offending party shall thereupon have the right to terminate this agreement by giVing written notice to the other party of such termination and specifying the effective date thereof at least thirty days before the effective date of such termination, and all finished or unfinished docu- ments, data, surveys, drawings, maps and reports prepared by the Center shall become the property of the City. If such termina- tion is by the City, the Center shall not be entitled to any additional payments pursuant to paragraph 6 of this agreement from and after the date of said termination. If such termina- tion is by the Center, then the Center shall not be entitled .to any additional payments pursuant to paragraph 6 of this agreement from and after the effective date of such termination except to recover expenses incurred by Center which have not been refunded by City prior to the date of termination. Access to Records..i'The City of South San Francisco, the County of San Mateo, the U.S. Department of Housing and Urban Development, the Controller General of the United States, or any of their duly authorized representatives, shall have access to any books, documents, papers,.and records of the Center which are directly pertinent to the HCDA Program for the purpose of making audit, examination, excerpts, and transcriptions. 6. Payment For Services. In consideration of the services to be performed by~ the Center. pursuant to this agreement, City agrees to pay an amount not to exceed $40,000. The sum due to the Center shall be paid by the City as expenses are incurred and requisitions submitted. 7' Liaison,with City. Contact on work progress and budget matters will be maintained with the City through the Parks and Recreation Department's liaison representative.
