CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
RESOLUTION DECLARING OPPOSITION TO ANY COMMUTER
TAX PROPOSED FOR ADOPTION BY THE CITY AND COUNTY
OF SAN FRANCISCO.
BE IT RESOLVED by the City Council of the City of South San Francisco,
State of California, that:
WHEREAS, there are many residents of the City of South San Francisco
who are employed and work within the City and County of San Francisco and
commute to and from their homes and places of employment, and, thus, would
be adversely affected by any form of commuter tax imposed by San Francisco;
and
WHEREAS, the Mayor of San Francisco has publicly declared his intent
to propose and support the adoption of an ordinance to impose a tax solely
on non-resident commuters employed within the San Francisco jurisdiction on
the premise that said commuters do not make a fair share contribution to the
revenues necessary to support the City's services; and
WHEREAS, the City and County of San Francisco instituted such a com-
muter tax several years ago and said tax was subsequently declared uncon-
stitutional; and
WHEREAS, the type of tax being proposed is clearly unconstitutional
as discriminatory and a denial of equal protection as well as of due process
of law; and
WHEREAS. commuters do contribute substantially to the economic base
of the City and County of San Francisco in providing, promoting and patroniz-
ing the business establishments, all of which produce a s. ubstantial amount
of revenue in the form of sales taxes, business license fees, gross payroll
taxes, and many indirect taxes through the doing of business therein,
while their normal work day presence within the City, in their employment
pursuits, places only a minor burden upon the municipal services, and thus,
an additional tax imposed upon them would require a disproportionate con-
tri buti on from the commuter class;
NOW, THEREFORE, IT IS HEREBY RESOLVED, that:
1. It is the opinion of this City Council that commuters already pay
their fair share in taxes to the City and County of San Francisco, and that
the placement of an additional tax burden upon them would be unconstitutional
as discriminatory and a denial of equal protection of the laws.
2. This City Council hereby declares its opposition to any commuter
tax proposal and urges the Mayor and the Board of Supervisors of San Francisco
to take cognizance of the contributions made by commuters, to respect the
Courts' decisions that such taxes are discriminatory, and reject such proposals
forthwi th.

and adopted by the City Council of the City of South San Francisco at a
