HomeMy WebLinkAboutReso 142-1976 RESOLUTION NO. 142-76 CITY COUNCIL,CITY OF SOUTH SAN FRANCISCO,STATE OF CALIFORNIA A RESOLUTION SUPPLEMENTING THE PROVISIONS OF RESOLUTION NO. 31-76 ADOPTED MARCH 3, 1976 (GELLERT BOULEVARD EXTENSION PROJECT ASSESSMENT DISTRICT). WHEREAS, the City Council of the City of South San Francisco, (hereinafter designated Council), on March 3, 1976, adopted Resolution No. 31-76 entitled "A Resolution Regarding a Con- tribution to the Gellert Boulevard Extension Project Assessment District", a copy of which is attached hereto as Exhibit "A" and by this reference incorporated herein; and WHEREAS, the Council after considering the owner's.progress to date and the terms of said Resolution No. 31-76, holds the opinion that the provisions of said Resolution should be supple- mented to more adequately assure the purposes therein set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that said ResolurionNo. 31-76 be supplemented by adding the following provisions: 1. The sum included in the capital improvement budget pursuant to said Resolution No. 31-76 for fiscal year 19,76-77 as a contribution to the Gellert Boulevard Extension Project Assess- ment District shall not be appropriated, and authorization and priority therefor shall be l® said City or District, free and clear of all liens, taxes and encumbrances, except those accepted by Council authorization. I hereby certify that the foregoing Resolution was reg- ularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 6th day of October , 1976, by the following vote: AYES, COUNCILMEN Leo Padreddii, Emanuele N. Damonte and William A. Borba " Richard A. Battaglia and Terry J. Mirri NOES, ABSENT, None ATTEST: City Clerk cancelled unless: 1.1. Annexation by Thomas Callan of the properties described in Exhibit "B" attached hereto, is completed on or before the end of the sixth (6th) month after the date of this Resolution, which time may be reasonably extended by the Council. Said annexation proceeding is presently pending before the Local Agency Formation Commission of San Mateo County, and 1.2. The Council determines, based on evi- dence submitted by Thomas Callan within six (6) months after adoption of this Resolution, or reasonable extension thereof authorized by the Council, that a national commercial estab- lishment with a projected sales volume of not less than eleven million dollars(S11,000.000) per year will be constructed on owner's site adjacent to and served by the said road extension within one (1) year after adoption of the Resolution, and 3.3.
