A RESOLUTION AUTHORIZING THE EXECUTION 'OF THE CITY
OF SOUTH SAN FRANCISCO'S AGREEMENT WITH THE COUNTY
OF SAN MATEO FOR SERVICES .IN HOUSING AND COMMUNITY
DEVELOPMENT AS DESCRIBED IN SAID AGREEMENT
BE IT RESOLVED by the City CoUncil of the City of South San
Francisco that execution of the agreement for.services between the County

of San Mateo and the City of South San Francisco, a municipal corporation,
· ,
'a copy 'of which .is-attached hereto as Exhibit "A" is hereby-authoriz~ed,
and the City Manager is authorized to execute said agreement fOr services
on behalf of the City, and the City Clerk attest his signature thereto.

JOINT POWERS AGREEMENT
THIS AGREEMENT, by and between the CITY OF SOUTH SAN FRANCISCO,
(hereafter "City"), and the COUNTY OF SAN MATEO, (hereafter "County),
entered into this_ day of . , 1976.
W I TN E S S E TH:
WHEREAS, City is empowered under the statutes and regulations of
the State of California to promulgate and implement a housing rehabilita-
tion plan within the incorporated boundaries thereof using funds generated
by the application of County for a federal Housing and Community Develop-
ment Block Grant; and
WHEREAS, County is likewise empowered to prOmulgate and implement
a housing rehabilitation plan within the unincorporated areas of the
County of San Mateo and has, prior to this date, effected the operation
of such a plan; and
WHEREAS, City desires for County to implement and operate the housing
rehabilitation plan for City within the incorporated limits of City, and-
County desires to perform that taSk for City.
NOW, THEREFORE, IT IS HEREBY AGREED as follows:
1. Maintenance of Physical Facilities for Operations' City shall
provide a suitable office space for one (1) County employee
who will be placed in City to operate said housing rehabilita-
tion program therein, said office space to be located at 291
Hillside Boulevard in conjunction with the current office
facilities of the Information and Referral Center (IRC). City
shall also provide the necessary secretarial services to support
the County employee, said services to be provided by the

Information and Referral Center (IRC) staff.
2. Services_.Provided: The County shall provide the following
services'
a. County shall implement and operate the housing
rehabilitation plan, as described generally in
the attached Housing Improvement Program, within
the incorporated limits of City, using existing County
Housing Code standards, rehabilitation procedures and
forms.
b. Loan applicants from the City shall be screened by
the County Loan Committee using guidelines and priori-
ties approved by the South San Francisco Citizens
Advisory Committee-ad hoc. There shall be at least
one resident of the City appointed by the Citizens
'Advisory Committee to serve on said County Loan Commitee.
c. County will utilize all existing financing devices
for such program, as well as any of the same that
become available in the future, to the end that maxi-
mum use of Federal, State and private funds for housing
rehabilitation at a minimum of cost to local residents
served under this agreement may be achieved.
d. Should any financing device require the County to
purchase a note and deed of trust, or other document
evidencing indebtedness, because of the failure of the
homeowner-loan recipient to make payments as promised
to a housing rehabilitation loan made to a resident of
City, City shall reimburse County for all the costs

incurred thereby. All financial liability provided
for herein is to be dischargeable through the use of
HCDA Block Grant funds only.
e. All monies repaid, received, collected or returned .
to the County by loan recipients, their assigns or
heirs under this agreement shall be credited to Cit,v's
Housing and Community Development Block Grant account
for the continuation of the housing rehabilitation pro-
gram provided for herein.
f. It is the position of the City that all loan indebted-
ness shall be discharged by the loan recipients through
monthly payments or by the acceptance by the County
of a'trust deed in lieu of said monthly payments.
The use of any other method "ti' recapture loaned funds,
i.e. real property foreclosure, garnishment of wages,
attachment of personal private property, or liens on
real property, is expressly prohibited without the
prior approval of the City Council of the City of
South San Francisco. Such approval shall not be un-
reasonably withheld. All losses sustained by County
because of City's refusal to permit County to Collect
On any note and deed of trust by any means set forth
herein shall be deducted from City's current or future
Housing and Community Development Block Grant, in
County' s di screti on.
g. The County shall supervise the payments of block grant
funds made to all contractors or subcontractors performing

services or materials under the housing rehabilitation
program and shall require lien releases or proof of
same prior to the release of funds.
h. The County shall assure that all rehabilitation work
done within the City shall be in accordance with
the 1973 edition of the Uniform Building Codes, as
amended, local codes and ordinances, and shall obtain
copies of all permits and certificates of final in-
spection for work completed prior to the release of
the final loan payment to the recipients.
i..The County may elect to have the responsibilities as
set forth in "g" above discharged by a legally estab-
lished savings and loan association or banking
institution, in which case, said organization may
assure such responsibility ..and perform such services.
j. All work performed under this agreement shall be
performed by contractors licensed in the State of
California or the owner(s) of the property where
the work is performed, in accordance with the require-
ments set forth in the 1973 edition of the Uniform
Bui 1 ding Code.
k. The County shall reasonably assure that all workers,
laborers, craftsmen, employee or property owners
performing services under this housing rehabilitation
program shal1 be covered under the Workmen's Compensa-
tion Insurance Act of the State of California. Said
coverage shall be provided by the property owner(s).

1. The County shall reasonably assure that all Work per-
. formed under this agreement shall comply with all of
the requirements of the Occupation Safety and Health
Act, if there are any.
m. All loan agreements shall contain a hold harmless
statement which shall set forth that the:
"City of South San Francisco and the County of
San Mateo are to be held harmless from any act,
action, or activities of the recipient or the
agents, contractors, or subcontractors which
result in accidents, injury or death to any person
performing work, living or visiting upon or near
any property for which a loan has been made under
this agreement."
3.: Term and Termination of the Agreement' The term of this Agree-
ment shall be from the day of , 1976,
to the 31st' day of July 1977. This Agreement may be extended or
amended at any time with the written consent of both parties.
This Agreement may be terminated by either party upon sixty days
written notice.
4. Payment for Services' In consideration of the services provided
by the County pursuant to this Agreement, City agrees to pay an
amount not less. than $20,000 or a sum not to exceed $28,000.
The sum will be paid from HCDA Block Grant funds as expenses
are incurred.

5. Liaison with City' Contact on work.progress and budget
matters will be maintained with the City through the City's
Planning Division.
IN WITNESS THEREOF, the 'parties hereto have caused-this A. greement
to be executed the day and year first written above.
