HomeMy WebLinkAboutReso RDA 16-1981 RESOLUTION NO. 1'6' RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SOUTH SAN FRANCISCO ADOPTING RULES FOR OWNER PARTICIPATION WITHIN THE GATEWAY REDEVELOPMENT PROJECT RESOLVED BY THE MEMBERS OF THE REDEVELOPMENT AGENCY OF THE CITY OF SOUTH SAN FI~NCISCO: WHEREAS~ in furtherance of the objectives of the Commun£ty Redevelopment Law, the Agency has undertaken a program for the clearance and reconstruction or rehabilitation of slum and blighted areas in the City and in this connection is engaged ~n carry±ng out a redevelopment project known as the Gateway Redevelopment Project (hereinafter referred to as "Project"~_, in an area (hereinafter referred to as "Project Area"), located in the City; and WHEREAS, in furtherance of the implementation of Project the Agency has undertaken various redevelopment activities and contemplates further redevelopment activities consisting of, inter alia, the adoption of a final Redevelopment Plan; and WHEREAS, the Community Redevelopment Law, Division 24 of the California Health and Safety Code,(Sections 33380, 33381, 33345, 33340, 33339) provides for participation in a Redevelopment project by the owners of properties situated therein subject to certain conditions including compliance with the Redevelopment Plan; and WHEREAS, the provisions pertaining to the aforesaid owner participation are incorporated in the proposed Gateway Redevelopment Plan which will be adopted by the legislative body and the Agency of the City of South San Francisco; and WHEREAS, the Redevelopment Agency of the City of South San Francisco on this date had presented to it rules for "Owner Participation" within the Gateway Redevelop- ment Project, copies of which are on file at the Redevelopment Agency office; and WHEREAS, said Redevelopment Agency desires to adopt said rules for redevelopment of property in the Gateway Redevelopment Project in the form presented to it on this date; NOW, THEREFORE, BE IT RESOLVED BY THE REDEVELOPMENT AGENCY OF THE CITY OF SOUTH SAN FRANCISCO AS FOLLOWS: THAT, the attached "Owner Participation Rules" has been reviewed and is found to meet the requirements of the Community Redevelopment Law, Division 24, Part 1, Chapter 4, Article 4, Section 33345; and THAT, the attached "Owner Participation Rules" for the Gateway Redevelopment Project are hereby adopted. No. 16 -~journed Regular Meeting ,,dy 21, 1981 THE REDEVELOPMENT AGENCY OF THE CITY OF SOUTH SAN FRANCISCO RULES FOR OWNER PARTICIPATION IN GATEWAY REDEVELOPMENT PROJECT 1. PurpOse. These rules have been adopted by the Redevelopment Agency of the City of South San Francisco (here- inafter called "the Agency") pursuant to Section 33345 of the California Community Redevelopment Law to implementing the operation of owner participation in connection with the Gateway Redevelopment Plan for the Project. It is the intention of the Agency to encourage, to the greatest extent practical, the participation of property owners in carrying out the Plan. 2. Applicability. These rules shall apply to all properties within the project area whether privately or publicly owned. 3. Eligibi~itY. for Owner Participation. Eligibility of proper- ty for retention under an Owner Participation Agreement shall be determined solely by the Agency. In general, properties in areas within the project scheduled for redevelopment may be eligible for owner participation, provided all the require- ments of the Redevelopment Plan are met. Properties located in areas scheduled for public use are not eligible for retention under an Owner Participation Agreement. 4. Proposals. Each owner desiring to participate in the Project as an Owner Participant shall submit a written project to the Agency staff. The Owner Participation proposal shall include all contemplated activity, both rehabilitation and upgrading along with the proposed time schedule for completion and the manner in wh±ch the participation conforms to the Redevelopment Plan. The Agency shall then determine whether the proposal conforms to the Redevelopment Plan and is acceptable and so advise the owner. Provided the proposal is found acceptable to the Agency, each owner will be required to enter into a contract with the Agency including but not limited to the following: 1, Proof of compliance with the standards and uses to be in conformance with the Redevelopment Plan 2. Proof that architectural treatments to the building exterior are in harmony with adjacent properties and acceptable to the Agency. 3. The execution of a non-discrimination provision. 4. Proof of financial responsibility. 5. owner. P.ar.~±ci~ation Agreements. Each Owner Participation Agreement shall set forth the terms and conditions by which the owner may retain the property and comply with the Redevelop- ment Plan, including specific requirements for construction, repair, alteration, reconstruction, and rehabilitation to be carried out in accord with the policies of the Agency. The time for beginning and completing such work shall be set forth in the Agreement to the extent possible. The Agreement shall also contain such other terms considered necessary by the Agency to effectuate the purposes of the Redevelopment Plan. 6. Time for Execution of Owner Participation Agreements. When the Agency notifies a property owner of his eligibility to execute an Owner Participation Agreement, the Agency shall also stipulate the date by which such Agreement must be executed by the owner. 7. Amendment. These rules may be amended from time to time by the Agency.
