HomeMy WebLinkAboutReso 164-1976 RESOLUTION NO. 164-76 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ESTABLISHING SCAVENGER RATES AND CHARGES FOR 1977 AND 1978, AND AUTHOR- IZING AN AGREEMENT FOR SCAVENGER SERVICES AND RELATED MATTERS. WHEREAS, the City Council of the City of South San Francisco, on November 10, 1976, did conduct a public hearing after notice published on the 29th day of October, 1976, in the Enterprise Journal, a newspaper of general circulation published and circulated in the City of South San Francisco; and WHEREAS, the Council at said hearing considered the presentation of "Scavengers",financial analyses by City staff, quality of service, presen- tation of interested parties, reasonableness of rates and charges, and items recommended by staff for inclusion in an agreement between the City and "Scavenger" for "Scavenger's"services as contained in the Staff ._ Reports dated November 12, 1976 and November 17, 1976, copies of which are on file in the office of the City Clerk; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Franicsco, that: 1. Rates and Char.qes. The rates and charges for "Scavenger" service in the City of South San Francisco for the years 1977 and 1978, shall be as set forth in Exhibit "A" attached hereto and by this reference made a part hereof. The rates and charges for 1977 shall be those rates set forth in Exhibit "A" ® II]! Il r~lll il Ii in the column titled "PROPOSED 1-1-77", on pages i and 2, and the multi pick-up schedule on page 3, and the rates for 1978 shall be those set forth in the multi pick-up schedule on page 3 and in the column titled "PROPOSED 1-1-78", except that any increases as shown in said column shall not take effect unless the Council, after review of the Auditor's report, approves same. 2. Amendment of Contract or Franchise Terms. Amendment of the existing contract or franchise between the City of South San Francisco, a municipal corporation, and the South San Fran- cisco Scavenger Company, a co-partnership, now South San Francisco Scavenger Company, Inc., a California corporation, 69 South Linden Avenue, South San Francisco, California, providing for "Scavenger" services in the City of South San Francisco to include but not be limited to the following provisions, is hereby authorized. 2.1. Monthly lawn. clipping and shrubbery cutting pick- up service cost shall be incorporated in the monthly rate. 2.2 Curbside service shall be required as follows: A.Single Family, Duplex and Triplex Resi- den ti a 1 un i ts. - Garbage r~eceptacles for single family, duplex and triplex residential units shall be placed in an accessibl-e area on the premises within eight feet (8') of the face of the curb, or in absence of a curb, not less than eight feet (8') from the edge of the improved right of way. An alternate location may be e 2.3 permitted for (1) the premises of a disabled person, and (2) the premises for which such a location may constitute a nuisance. B. Apartments, Manufacturin.q, Commercial and Other Premises Not Described'in Section A. Garbage receptacles shall be located in a place on the premises which is readily accessible for removal and emptying by City's contractor or franchisee. Mandatory pick-up service and direct billing of of owners of apartments and multiple dwelling uni ts. The following shall arrange for and have garbage collection service and shall pay the established rates and charges: A. Owners or occupants of each and every single family residential unit; B. Owners of each and every multiple dwelling unit, occupied hotel, apartment house, rooming house, motel, auto court, trailer park or other such place of abode located in the City. C. Owners or occupants of each and every e fl'i[ I! [TIITIIIIII premises occupied for business,commercial or industrial use located in the City. 2.4 Cost of "Scavenger" service to the City. City shall pay Scavenger Company the full cost of services provided to the City, now estimated at Eight thousand five hundred dollars ($8,500) per year. 2.5 Franchise Fee. "Scavenger" shall pay City a franchise fee of one and one-half percent (1½%) of gross revenues, now estimated at Twenty-seven thousand dollars ($27,000) per year. 2.6 Franchise Term. The franchise term shall be for ten (10) years wi th optiOn~ for two (2) - five (5) year renewals. 2.7 Audi tor' s Report. "Scavenger" shall submit an Auditor's report each year to the City. 2.8 Rate Modification. Proposed rate modifications shall be reviewed six (6) months prior to approving such modifications. 3. Publication. The City Clerk shall publish this Resolution once within fifteen (15) days after adoption in the Enterprise Journal, a newspaper of general o IfilI!
