HomeMy WebLinkAboutReso 165-1976 RESOLUTION NO. 165-76 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO,STATE OF CALIFORNIA A RESOLUTION APPROVING CATV SUBSCRIBER RATE INCREASES EFFECTIVE JANUARY 1, 1977. BE IT RESOLVED by the City Council of the City of South San Francisco that the Council, in a public hearing on the lOth day of November, 1976, due notice of which was given by publication on the 29thday of October , 1976, in the Enterprise-Journal,a newspaper published and circulated in the City of South San Francisco, a copy of which notice is attached hereto as Exhibit "A"; having considered Western TV Cable's subscriber rate increase request by letter dated July 7, 1976; and the material thereafter supplied, copies of which are on file with the office of the Acting Director of Finance; the report and recommendations of the staff; the written and oral statements made at said hearing and all factors set forth therein; and having closed the hearing and continued the matter to November 17, 1976, for determination; finds and determines as follows: A. The increase in cost is justified and is consistentwith the current policy. B. The subscriber rate increases hereinafter set forth are warranted from a consideration of all the factors related to subscriber rates, includ- ing but not limited to increased costs of operation, gross revenues, projected increase or loss in number of subscribers, capital expenditures, and additional requirements of the Federal Communication Commission; and said increases or schedule of reasonable rates and charges which will prevent excessive charges and assure fair compensation to the Grantee. C. The subscriber rates as initially set forth in Section 6 of Ordi- nance No. 563, adopted June 19, 1967, as amended in Section I of Resolution No. Ill[ I! [illll 111 II 5907, passed August 7, 1972, and Resolution No. 6156, adopted August 20, 1973, should be reasonably increased. NOW, THEREFORE, THE COUNCIL ORDERS THE FOLLOWING: 1. Subscriber rates now Set forth in' Section 6 of Ordinance No. 563, · adopted June 19, 1967, as aniended by Resolution No. 6156, adopted August 20, 1973, shall be increased as of January 1, 1977, to read as follows.: (a) Single-use premises - individual subscriber (residential and commercial) The monthly service charge shall not exceed $6.40 for the first single receiving set or appar- atus (primary outlet) and for each receiving set or apparatus in excess of one at the location of any such subscriber, a sum not to exceed $7.75 per month. (b) Municipal and South San Francisco Unified School District. : There. shall be no monthly service charge for service to the occupied · . municipal properties of the City of South San Francisco or the South San' Francisco Unified School District within the corporatb limits of the City. (c) Hotels, motels, multiple dwellin~qs and other buildinqs. The monthly service charge for hotels, motels, multiple dwellings and other buildings, as more particularly described in Section 5 (C) of Ordinance No. 563, shall not exceed $6.40 ~... for service, to the antennaplex or other distribution system and the primary outlet, and $1.75 monthly for each outlet from said antennaplex or other distribution system within the premises for each additional primary outlet. . The monthly service charge shall not exceed $1.75 for the first single receiving set or apparatus (pri- mary outlet) and for each receiving set or apparatus in excess of one at the location of any such subscriber, a sum not to exceed $1.75 per month. '2'~ If cOpyright liability is imposed by any court with jurisdiction thereof or by the Congress, Western TV Cable shall have the right to increase its rates for' regular subscriber services covered under l(a}, (c) and (d)of this Resolution to offset such copyright liability. Any increase in the rate schedule because of the imposition of copyright liability shall be limited to the actual amount of liability imposed by a court having juris- diction thereof or by the Congress. There shall be no charge for copyright liability for service provided in section l(b) of this Resolution. If such copyright liability is imposed by a court with jurisdiction thereof or by the Congress, Western TV Cable shall file notice thereof with City's Director of Finance together with supporting evidence. City's Direc- tor of Finance shall verify the amount of the copyright liability so imposed and upon making said verification issue an approval to increase the rates in said sum, same to be effective thirty (30) days after notice of the rate increase is issued to subscribers stating the amount of the monthly increase. 3. The rates and charges established by this Resolution shall be effect- ive f. or one (1) year commencing Ja'nuary 1, 1977. II,Ir I1~ r illll i111 4. Publication. The Clerk shall publish this Resolution once within fifteen (15) days after adoption, in the Enterprise Journal, a newspaper of general cir- culation published in the City of South San Francisco.
