HomeMy WebLinkAboutReso 32-1977 RESOLUTION NO. 32-77 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING FILING APPLICATION FOR FEDERAL AND STATE GRANTS FOR NORTH BAYSIDE SYSTEM UNIT WASTEWATER PROJECTS C-06-1235 AND C-06-1267 AND RELATED MATTERS. WHEREAS, (1) the Cities of Burlingame, Millbrae, San Bruno and South San Francisco, municipal corporations of the State of California (hereinafter Burlingame, Millbrae, San Brun'o and South San Francisco), and (2)' the City and County of San Francisco, acting by and through its Airport Commission (hereinafter Airport) are undertaking the North Bayside System Unit Wastewater Projects C-06-1235 and C-06-1267, and WHEREAS, the agencies, with the assistance of a Step I Grant, par- ticipated in the preparation of the following project reports by Jenks and Harrison, Consulting Sanitary and Civil Engineers; (1) Project Report C-06-1235. A project report entitled "North Bayside System Unit, Wastewater Treatment Facilities Improvements (subregional Dechlorination Facilities; South San Francisco-San Bruno Treatment Plant Improvements)" dated January 3, 1977. (2) Project Report C-06-1267. A project report entitled "North Bayside System Unit, Subregional Wastewater Solids Manage- ment Project," Dated August, 1976, and WHEREAS, South San Francisco is participating in the portions of said projects as more particularly hereinafter described, and (Rev. 3/23/77) le IIIII II g;l~II 111 II WHEREAS, South San Franc~.sco is also serving as lead agency for said projects~, and WHEREAS, the participating agencies are pursuing completion of a joint powers agreement for said projects, and pending completion thereof South San Francisco, as lead agency, needs authorization from the par- ticipating agencies to file Federal and State grant applications for eighty-seven and one-half percent (87.5%) of the eligible items ~or said projects, execute an agreement with Consulting Engineers RETA/Nolte and Associates, and do related acts pending execution of a joint powers agree- ment, and WHEREAS, South San Francisco as a participating agency desires to authorize the filing of Federal and State grant applications for eighty- seven and one-half percent (87.5%) of the eligible items for said proj- ects, execute an agreement with Consulting Engineers RETA/Nolte and Associates, and do related acts pending execution of a joint powers agree- ment; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco as follows: 1. Project applications. South San Francisco, as a participating agency and as lead agency for the participating agencies, authorizes Frank J. Addiego, Director of Public Services of South San Francisco, to sign and file the following project applications upon receipt of resolutions from the participating agencies so providing: a. Project Application C-06-1235, an Application for Federal Assistance (For Construction Programs), State Clearinghouse e fl]Iii Ii [iE['l ~]l l! )]dentifi er 76111171. b. Project Application C-06-1267, an Application for Federal Assistance (For Construction Programs), State Clearing- house Identifier 76052492. 2. Consulting Engineers' Agreement. South San Francisco as a par- ticipating agency, and as lead agency for the participating agencies, authorizes Frank J. Addiego, Director of Public Services of South San Francisco, to execute an agreement with RETA/Nolte Associates, Consult- ing and Environmental Engineers, for the design of the project facilities upon receipt of resolutions from the participating agencies so providing. 3. Cost Participation in Step II Design. South San Francisco shall participate in those portions of the Step II design for said projects as set forth in Exhibit A attached hereto, and shall pay the percentage of cost .therefor remaining after crediting Federal and State grants received, which percentage of cost has been equitably determined in accordance with Federal and State revenue guidelines. The said percentages of cost are set forth on Exhibit B attached hereto. 4. Payment to Lead'Agenc.v~for Disbursement, Step II Desi.qn. Frank J. Addiego, the lead agency administrative officer and Di'rector of Public Services of South San Francisco, shall determine the sum necessary to defray the current monthly payment to the consulting engineers and/or cost related to the dechlorination facility land site acquistion. Upon making determination, he shall give written notice to each participating agency of the portion of said agency's percentage of said cost, with the requirement that that sum be remitted to the lead agency within 3, III1[ II glill iii I! fifteen (15) days after receipt of said notice for disbursement by the lead agency, Notice to South San Francisco as a particiPating agency shall be given to the City Manager, 5. construction~ South San Francisco shall participate in the construction of the facilities described in Exhibit A attached hereto and its share of construction, operation and maintenance cost which shall be determined in accordance with Federal and State revenue guide- 1 ines. 6. Joint Powers Agreement. South San Francisco shall diligently pursue the execution of a joint powers agreement with the other named agencies in accordance with Federal and State regulations,providing for the design, construction, operation, maintenance and use of said facilities. 7. Authorizations and Assurances. The City COuncil of South San Francisco, in addition to authorizing and directing Frank J. Addiego,as administrative officer for South San Francisco as lead agency, and as a representative of South San Francisco as a participating agency, to file an Application for Federal Assistance under the Federal Water Pollution Control Act, as amended (33 U.S.C. 1251, et seq.) and any agreements or other documents necessary to secure and receive grants under said Act, and a State grant under the Clean Water Bond Law of 1970 / and/or 1974 construction of said projects, does hereby agree and further authorize Frank J. Addiego, as administrative officer of South San Francisco as lead agency and as a representative of South San Francisco as a participati~ng .agency, to certify that if grants for its projects o fi]ti! I! liilll ffl l! are made pursuant to the aforementioned Federal and State statutes it will comply with all applicable Federal and State Statutory and regula- tory requirements, including but not limited to the assurances'con- tained in the Federal Grant Application and the State Grant Contract; the Freedom of Information Act, 5 U.S.C. 552, as amended, relating 'to the right of the public to obtain information and records; the National Historic Preservation Act of 1966, U.S.C. 470, et seq., as amended, re- lating to the preservation of historic landmarks; the Copeland (Anti- Kickback) Act, 18 U.S.C. 874, 40 U.S.C. 276c,and the regulations issued .thereunder, 29 CFR 3.1, et seq.; and the Contract Work Hours and Safety Standards Act, 40 U.S.C. 327, et seq., and the regulations issued thereunder.
