HomeMy WebLinkAboutReso 49-1977WJML:KIJ:ar 4/27/77 · RESOLUTION NO. 49 -77 A RESOLUTION DETERMINING THAT THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO HAS JURIS- DICTION TO PROCEED WITH THE ISSUANCE OF SEWER REVENUE BONDS NORTH BAYSIDE SYSTEM UNIT WASTEWATER TREATMENT AND SOLIDS MANAGEMENT PROJECT SEWER REVENUE BONDS OF 1977 RESOLVED, by the City Council of the City of South San Francisco, California, that WHEREAS, on April 6, 1977, the City Council of the City of South San Francisco adopted its Resolution No. 33-77, A -Resolution of Intention to Issue Sewer Revenue Bonds, North Bayside System Unit, Wastewater Treatment and Solids Management 'Project, all as more particularly described therein, fixing Wednesday, the 4th day of May, 1977, at the hour of 7:30 p.m., at the regular meeting place of the Council, West.Orange Avenue Library, 840 West Orange Avenue, South San Francisco,. California, as the time and place when and where persons interested might appear before said Council and be heard as to any protests or objections they might have against the acquisition and construc- tion of the proposed works and the issuance and sale of revenue bonds therefor; WHEREAS, a copy of said Resolution was published twice in the Enterprise Journal, a newspaper published and circulated in the City, the second of which publications was at least ten days before the day set for 'hearing; WHEREAS, copies of said Resolution headed "Notice of Sewe~ Works" in letters not less than one inch in height, have been posted at least ten days before the time set for hearing· at not less than 300 feet in distance apart and along the entire length of E1 Camino Real within the City limits, said street being, in the opinion of said Council, the street in said City traversed by the largest number of people; WHEREAS, affidavits of publication and posting of said notice are on file in the office of the City Clerk; WHEREAS, plans and specifications of said work and improvements to be constructed prepared by consulting engineers, which were and are on file in the office of the City Clerk, had been approved by the City Council and were referred to in said Resolution of Intention; WHEREAS, all persons interested desiring to be heard were given an opportunity to be heard at said hearing and all matters and things pertaining to said project and said proceedings were fully heard and considered by said Board; and WHEREAS, the works to be acquired and constructed consist of: The construction of subregional dechlorination facilities, in-plant improvements to the South San Francisco-San Bruno wastewater treatment plant, and subregional wastewater solids treatment disposal and management facilities, together with the acquisition of lands, easements and rights necessary for any'of the above,~ all as required to meet the discharge and disposal requirements and standards established by the San Francisco Bay Regional Water Quality Control Board on behalf of both the state of California and the Federal Environmental Protection Agency. -2- NOW, THEREFORE, said Council does hereby FIND, DETERMINE and ORDER, as follows: 1. That the estimated cost of acquisition, construction and financing of said works to be acquired and constructed is the sum of $6,400,000, of which amount $5,300,000 is to be financed by federal and state grants and other local agencies and $1,100,000 is to be contributed by the City. 2. That the amount of revenue bonds to be issued and sold is $1,100,00'0. 3. That before the conclusion of the aforesaid hearing, a petition was not filed with said Council, signed by not less than 15 percent of the owners or by not less than 15 percent of the registered voters within the area described in said Resolution of Intention, requesting that the Council submit the proposition of acquiring or constructing the proposed works or issuing said bonds to an election of the registered voters in said area. 4. That the City Council has jurisdiction to proceed pursuant to the Sewer Revenue Bond Act of 1933, Chapter 5 (commencing with Section 4950) of Part 3, Division 5 of the Health and Safety Code of the state of. California, with the acquisition and construction of the proposed works and improve- ments and the issuance and sale of revenue bonds therefor. -3- I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held this day of Ma~ , 1977, by the following vote: 4th AYES, COUNCILMEMBERS NOES, ' COUNCILMEMBERS ABSENT, COUNCILMEMBERS Richard A .
