HomeMy WebLinkAboutReso 65-1977 RESOLUTION NO. 65-77 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION OF INTENTION TO VACATE A PORTION OF MISSION ROAD. BE IT RESOLVED by the City Council of the City of South San Francisco as follows: 1. This Resolution of Intention is adopted pursuant to the Street Vacation Act of 1941 (Streets and Highways Code Sections 8300, et seq.). 2. Public interest, convenience and necessity require, and it is the intention of this Council to vacate the right of way for street and highway purposes in, over, across and through a portion of Mission Road described as follows: All that certain real property situate in the City of South San Francisco, County of San Mateo, .State of California and more par- ticularly described as follows: Beginning at the northwesterly corner of the lands conveyed to Raymond Wong et al by Deed recorded June 11, 1975 in Book 6864, Official Records of San Mateo County, at Page 430 (Recorder's Serial No. 57780-AI), said point of beginning also being the intersection of the southeasterly line of Oak Avenue and the northeasterly line of Mission Road (66 feet wide); thence from said point of beginning along the northeasterly line of Mission Road North 32o 38' 31" West 96.21 feet to northwesterly corner of that parcel of land conveyed to the San Mateo County Flood Control District by Quitclaim Deed recorded July 23, 1976 in Book 7195, Official Records of San Mateo County, at Page 527; thence crossing Mission Road in a northwesterly direction, North 620 54' 14" West 130.97 feet to a point in the southwesterly line of Mission Road; thence along said southwesterly line South 32o 38' 31" East 234.19 feet; thence leaving said southwesterly line of Mission Road on the arc of a curve to the right, tangent to L~. a line which bears North 320 33' 33" East, said curve having a radius of 50 feet and a central angle of 380 42' 57", an arc distance of 33.15 feet to a point in the centerline of Mission Road; thence along the centerline of Mission Road North 32o 38' 31" West 13.26 feet; thence North 870 20' 05" East 32.06 feet; thence South 580 28' 14" East 12.00 feet to a point in the northeasterly line of Mission Road; thence along said north- easterly line, North 320 38' 31" West 35.18 feet to the point of beg i nni ng. ; r i B ! ~ i' I 3. The public interest, convenience and necessity require the reserva- tion of the following public service easements and this vacation proceeding is taken subject to such reservations and exceptions. The City intends to and does reserve and except from this vacation proceeding the following' A. A public service easement for the maintenance and operation of under- ground gas mains by Pacific Gas and Electric Company through the follow- ing-described parcel' ,.All that certain real property situate in the City of South San Francisco, County of San Mateo, State of California, and more particularly described as follows' Beginning at the northwesterly corner of the lands conveyed to Raymond Wong et al by Deed recorded June 11, 1975 in Book 6864, Official Records of San Mateo County, at Page 430 (Recorder's Serial No. 57780-AI), said point of beginning also being the intersection of the southeasterly line of Oak Avenue and the northeasterly line of Mission Road (66 feet wide); thence from said point of'beginning along the northeasterly line of Mission Road North 32o 38' 31" West 96.21 feet to northwesterly corner of that parcel of land conveyed to the San Mateo County Flood Control District by Quitclaim Deed recorded July 23, 1976 in Book 7195, Official Records of San Mateo County, at Page 527; thence North 62o 54' 14" West 3.97 feet to the TRUE POINT OF BEGINNING; thence from said true point of beginning North 62o 54' 14" West 39.69 feet; thence South 32o 38' 31" East 114.29 feet; thence South 20o 38' 31" East 31.27 feet; thence North 87o 20' 05" East 20.57 feet; thence North 20o 38' 31" West 41.77 feet; thence North 32o 38' 31" West 80.00 feet to the true point of beginning. B. A public service easement for the construction, reconstruction, improvement, maintenance and operation of underground telephone cable and appurtenant facilities by Pacific Telephone and Telegraph Company in, over, across and through the following-described parcel- All that certain real property situate in the City of South San Francisco, County of San Mateo, State of California and more par- ticularly described as follows' e Beginning at the northwesterly corner of the lands conveyed to Ra~ond Wong et al by Deed recorded June 11, 1975 in Book 6864, Official Records of San Mateo County, at Page 430 (Recorder's Serial No. 57780-AI), said point of beginning also being the intersection of the southeasterly line of Oak Avenue and the northeasterly line of Mission Road (66 feet wide); thence from said point of beginning along the northeasterly line of Mission Road North 320 38' 31" West 96.21 feet to northwesterly corner of that parcel of land conveyed to the San Mateo County Flood Control District by Quitclaim~Deed recorded July 23, 1976 in Book 7195, Official Records of San Mateo County at Page 527; thence~ North 62o 54; 14" West 89.31 feet to the TRUE POINT OF BEGINNING; thence from said true point of beginning North 620 54' 14" West 19.84 feet; thence South 320 38' 38" East 211.63 feet; thence on the arc of a curve to the right, tangent to a line which bears North 46o 01' 24" East, said curve having a radius of 50 feet and a central a~ngle of 110 32' 32", an arc distance of 10 07 feet; thence North 32v 38' 38" West 193.49 feet to the true point of beg i nni ng. C. An easement for existing overhead electrical and telephone lines over the entire parcel to be abandoned. 2. Notice is hereby given that Wednesda~ , the lSth day of , 1977 , at 7:30 p.m., which time is not less than fifteen (15) days from the date of passage of this Resolution, in the West Orange Avenue Library (in the room referred to as the Auditorium), 840 West Orange Avenue, South San Francisco, California, is hereby fixed as the time and place when and where all persons interested in, or having objections to, the pro- posed vacation of said portion of Mission Road subject to said exceptions and reservations may appear before said Council and be heard. 3. Reference is hereby made to the map or plan entitled "Proposed Aban- donment of Portion of Mission Road" dated March 28, 1977, prepared by the Department of Public Works of San Mateo County, which delineates the portion of Mission Road to be vacated and abandoned and the public service easements to be reserved and excepted. Said map or plan is on file in the office of the City Clerk and available for public inspection. A copy of said map is attached hereto as Exhibit A. 3, 4. A copy of this Resolution shall be published once in the Enterprise- Journal, a newspaper of general circulation printed and published in said City, within fifteen (15) days after adoption. 5. Notice of this street vacation shall be posted conspicuously along the line of the part thereof proposed to be vacated at least ten (10) days before the date set for hearing, and not less than three (3) notices shall be posted along said portion of said street not more than three hundred feet (300') apart, same to be completed at least ten (10) days before the date set for the hearing. The notices shall state the passage of the Resolution of Intention and the time and place of hearing. 6. A copy of this Resolution shall be submitted to the Planning Com- mission of the City of South San Francisco for report and recommendation in accordance with the Government Code of the State of California and Resolution 24-77 adopted by the City Council February 23, 1977.
