RESOLUTION NO. 27
A RESOLUTION OF THE SOUTH SAN FRANCISCO
REDEVELOPMENT AGENCY AUTHORIZING LITIGATION TO
COMPEL THE SECRETARY OF THE AGENCY
TO PUBLISH A NOTICE
WHEREAS, The South San Francisco Redevelopment Agency (the "Agency") on
December 16, 1981, adopted the Resolution No. 26 entitled "A Resolution
of The South San Francisco Redevelopment Agency Authorizing and Directing the
Sale of $12,000,000 Principal Amount of The South San Francisco Redevelopment
Agency Gateway Redevelopment Project 1982 Tax Allocation Bonds and Notes,
Adopting Official Not-ice of Sale and Authorizing Official Action"; and
WHEREAS, the Secretary of the Agency, although being in favor of the
Agency proceeding with the issuance of the Bonds referred to in the Official
Notice of Sale incorporated in said Resolution, has respectfully refused to
publish the Official Notice of Sale on the ground that it, is or may be,
invalid;
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED, as follows:
1. Herman H. Fitzgerald, General Counsel of The South San Francisco
Redevelopment Agency, is hereby authorized and directed to institute and carry
to conclusion an appropriate legal action to compel the Secretary of the
Agency to publish the Official Notice of Sale referred to herein.
2. This Resolution shall take effect from and after the date of its
passage and adoption.
