HomeMy WebLinkAboutReso 97-1977RESOLUTION NO. 97-77 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING AND ACCEPTING AMENDMENT 2-77 TO THE MEMORANDUM OF UNDERSTANDING, UNIT I - MANAGEMENT, JULY 1, 1975 - JUNE 30, 1978, AS AMENDED. BE IT RESOLVED by the City Council of the City of South San Francisco that: 1. Amendment 2-77 to Unit I - Management Memorandum of Understanding. The Council on June 30, 1975, by Resolution No. 85-75 approved and accepted Unit I - Management Memorandum of Understanding entitled "Memorandum of Understanding, Unit I - Management, July 1, 1975 - June 30, 1978." Then on February 16, 1977, by Resolution No. 19-77, the Council amended said~ Memorandum of Understanding in Amendment 1-77. The Council hereby approves and accepts Amendment 2-77 to said Memorandum of Understanding, as amended, . a copy of which amendment is attached hereto as Exhibit A. 2. City Clerk's Endorsement. The City Clerk be and he is hereby authorized to endorse and initial the following on the face of page 2 of Amendment 1-77: "Time for establishment of the new base salary per Sec- tion 2.1 deferred, refer to Amendment 2-77 dated June 22, 1977." MEMORANDUM OF UNDERSTANDING UN.IT 1 - MANAGEMENT JULY 1, 1975 - JUNE 30, .1978, AS.AMENDED The City of South.San Francisco (hereinafter, City) and Unit I - Management, acknowledge and affirm that they have met and conferred in'good faith and in all respects fulfilled their obligations under law to meet and confer in good faith regarding this Amendment 2-77 to the Memorandum of Understanding, Unit I - Management, July 1, 1975 - June 30, 1978, as amended. Representatives of the City have agreed to present this M~morandum to the City Council for'approval and acCeptance and representatives .of ~nit I have agreed to present this Memorandum to their membership for approval and accept- ance. In consideration of the afore~oin§ prov~'sions and the covenants and conditions hereinafter set forth,/~'~it is agreed as follows: 1. Fire Department'Members - Time for Establishment of New Base Salary Deferred. Section 2.1 of Amendment 1-77, Memorandum of UnderStanding, Unit I - Management, July 1, 1975 - June 30, 1978, Except for Surviving Prdvisions, ., approved and accepted February 16, 1977, by Resolution 19-77, proVided for establishment of a new base salary on June 24, 1977, which time now must be deferred as set forth in Exhibit A attached hereto and made a part hereof. I'n addition to being an amendment to said Memorandum of Understanding, the provisions of Exhibit A shall be included in a resolution providing for pay- ment of salaries pending establishment of the new base salary.. Police Departmeni~ Members - Cost of Living Adjustment Deferred. Section 2C of the Memorandum of Understanding, Unit I - Management, July 1, 1975 -~June 30, 1978, approved and accepted June 30, 1975, by Resolution 85-75 provided for a cost of living adjustment payable on June 24, 1977, which now must be deferred as set forth in Exhibit A attached hereto and made a part hereof. In .addition to being an amendment to.said Memorandum of Understanding, the provisions of Exhibit A shall be included in a resolution providing for payment of salaries, pending an amendment' of said Memorandum of UnderStanding which will establish a new base salary in con- junction with the adoption of 2% a't age 50 retirement formula. The City Clerk is authorized to endorse and initial the following on page.2 of said Memorandum of Understanding- "Time for Police Department cost of living adjustment and Fire Department members' new base salary deferred, refer to Amendment 2-77 dated June 22, 1977 ." IN WITNESS WHEREOF, the parties hereto have executed this amendment 2-77 in the City of South San Francisco on the, 22nd day of-_ June 1977. CITY'S REPRESENTATIVE' City Manager EXHIBIT A EMPLOYEES' REPRESENTATIVES: EXHIBIT A TO AMENDMENT 2-77 UNIT 1 - MANAGEMENT ADOPTED BY RESOLUTION 97-77 DATED June 22 ~ 1977 Fire and Police Department Members of Unit 1. In accordance with the Memorandum of Understanding for Unit 1, accepted and approved on June 30, 1975, by Resolution. No. 85-75, as amended, the Fire and Police Department members of Unit 1 on June 24, 1977, shall accrue an adjustment in base salary in a percentage according to the annual percentage change in the cost of living as reflected in the Bay Area Cost of Living. Index for the preced- ing completed annual index period' (April to April). Said adjustment is one of the factors to be used in computing a new base salary for. fiscal year 1977-78. lhe other factor is an actuarial evaluation to be prepared by PERS which is not verified as of this date, lherefore, payment of' ~all or .any portion of the said accrued adjustment shall be deferred until.the new base salary is computed and established for fiscal year 1977-78 for (1) Fire Department'members in accordance with Amend- ment 1-77 to the Unit i Memorandum of Understanding approved and accepted February 16, 1977, by Resolution 19-77, and (2) Police Department members in accordance with a substantially similar amendment to Unit I Memorandum of Understanding which is now being negotiated. If the new base salaries are not computed and established within ninety (90) days from the date of this amendment, then the accrued adjustment for the elapsed pay periods com,.~encing with June 24, 1977, shall be paid within ninety (90) days thereafter. If the new base salaries are so computed and established, the accrued adjustment for the elapsed pay periods commencing with June 24, 1977, up to the pay period when the new base salary is effective shall be paid within ninety (90) days thereafter.
