HomeMy WebLinkAboutReso 98-1977RESOLUTION NO. 98-77 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESQLUTION ACCEPTING AND APPROVING AMENDMENT 1-77 TO THE MEMORANDUM OF UNDERSTANDING, UNIT 5 - SOUTH SAN FRANCISCO POLICE ASSOCIATION, JULY 1, 1975 - JUNE 30, 1978. BE IT RESOLVED by the City Council of the City of South San Francisco that: 1. Amendment 1-77 to Unit 5 - South San Francisco Police Association Memorandum of Understanding. The Council on June 30, 1975, by Resolution No. 87-75 approved and accepted Unit 5 - South San Francisco Police Asso- ciation Memorandum of Understanding entitled "Memorandum of Understanding, Unit 5 ~ South San Francisco Police Association, July 1, 1975- June 30,. 1978." The Council hereby accepts and approves Amendment 1-77 to said Memo- randum of Understanding, a copy of which amendment is attached hereto as Exhibit A. 2. City Clerk's Endorsement. The City Clerk be and he is hereby .authorized to endorse and initial the following on the face of page 2 ~of said Memorandum of Understanding- "Time for Police Department cost of living adjustment .deferred, refer to Amendment 1-77 dated June 22, 19,7~" I hereby certify that the foregoing Resolution was regularly.intro- duced and adopted by the City Council of the City of South San Francisco at an adjourned reqular meeting held on the 22nd day of June , 1977, by the fol l owing vote: . . Mi rri and Leo Padreddii NOES, " None ABSENT, " None 2, ~ II |1 Ii 11111I~1 iI1 R~,3 EXHIBIT A TO OLUTION 98-77 ADOPTED A~IENDMENT 1-77 MEMORANDUM OF UNDERSTANDING UNIT 5- SOUTH SAN FRANCISCO POLICE ASSOCIATION July 1, 1975- June 30, 1978 ., .. 22, 1977 The City of South San Francisco (hereinafter, City) and Unit 5 - South San Francisco Police Association, acknowledge and affirm that they have met and conferred in good faith and in ali respects, fulfilled their obligations under law to meet and confer in good fai+~.,,~ regarding this Amend- ment 1-77 to the Memorandum of Understanding, Unit 5 -- South .San Francisco. Police Association, July 1, 1975 - June 30, 1978.. Representatives of the City have agreed to present this Memorandum to the City Council for approval and acceptance and representatives of Unit 5 have agreed to present this Memorandum to their membership for approval and acceptance. In consideration of the aforegoing provisions and the covenants and conditions hereinafter s~'t forth, it is agreed as follows- _ 1, Cost of Living Adjustment Deferred. Section 2C of the Memo- · randum of Understanding, Unit 5 - South San Francisco Police Association, July 1, 1975 - June 30, 1978, approved and accepted June 30, 1975, by Reso- lution No. 87-75 provided for a .cost of living adjustment payable on June 24, 1977, which now must be deferred as set forth in Exhibit A attached hereto and made a part hereof. In addition to being an amendment to said Memo- .randum of Understanding, the provisions of Exhibit A shall be included in a resolution providing for payment of salaries pending an amendment of said M~morandum of Understanding which will establish a new base salary in con- junction w.ith the adoption of 2% at age 50 retirement formula. The City Clerk is authorized to endorse and initial the following on page 2 of said ~iorandum of Understanding- "Time for Police Department cost of living. adjustment deferred, refer to Amendment i-77 dated June 22, 1977 ~ -. I1~ II IlrJ ~1~1 EXHIBIT A TO AMENDMENT 1-77 MEMORANDUM OF UNDERSTANDING U~IiT 5 - SOUTH SAN FRANCISCO POLICE ASSOCIATION ADOPTED BY RESOLUTION 9~-77 DATED June · Salaries for Members of Unit 5. In accordance with the Memo- randum of Understanding'.for Unit 5, accepted and approved on June 30, 1975, by Resolution No. '87-75, Police Department members of Unit 5 on June 24, 1977, shall accrue an adjustment in base salary in a percentage, according to the annual percentage change in the cost of-living as reflected in the Bay.Area Cost of-Living Index for the preceding completed annual index period (April to April). City and members of Unit 5 are negotiating an amendment to said Memorandum' of Understanding to provide the 2% at age 50 public safety retirement formula which will establish a new base salary and said adjustment is one of the factors to be used in computing a new base salary for fiscal year 1977-78. The other factor is an actuarial evaluation to be prepared by PERS which is not verified as of this date. Therefore, payment o'f all or any portion of the said accrued adjustment shall be deferred until the new base salary is computed and estab- lished for fiscal year 1977-78. If the new base salaries are not computed and established within ninety '(90) days from the date of this amendment, then the accrued adjustment for.the elapsed pay periods commencing with June 24, 1977, shall be paid within ninety (90) days thereafter. If the n~w base salaries are so computed and established, the accrued adjustment for the elapsed pay periods .commencing with June 24, 1977, up to the pay period when the new base salary is effective shall be paid within nihety (90) days thereafter.
