HomeMy WebLinkAboutReso 175-1977 RESOLUTION NO. 175-77 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING AND ACCEPTING AMENDMENT 2-77 - UNIT 6 - INTERNATIONAL ASSOCIATION OF FIREFIGHTERS OF AMERICA, LOCAL 1507, AFL-CIO, JULY 1, 1975 - JUNE 30, 1978, EXCEPT FOR SUR- VIVING PROVISIONS. BE IT RESOLVED by the City Council of the City of South San Francisco that: 1. AMENDMENT 2-77 to Uni't 6 Memorandum ~ of Understanding. The City Council hereby approves and accepts the Amendment entitled "Amendment 2-77, Memorandum of Understanding, Unit 6- Inter- national Association of Firefighters of America, Local 1507, AFL-CIO, July 1, 1976 - June 30, 1978, Except for Surviving Provisions", a copy of which Amendment is attached hereto as Exhibit "A". 2. City Clerk's Endorsement. ~ The City Clerk be and he is hereby authorized to endorse,date and initial the following on the Memorandum of Understanding, unit 6 - July 1, 1976 - June 30, 1978. 2.1. On page 2 at subparagraph"2:.1.1, place an asterisk,and at the bottom of the page endorse the following words' "*Subparagraph 2.1.1 amended. Refer to Amendment 2-77. (October 5, 1977AAR. )'" 2.2 On page 4 at subparagraph 2.1.2(c), place an asterisk, and at the bottom of the page endorse the following words: "*Subparagraph 2.1.2{c}amended. Refer to Amendment 2-77. ~ctober 5,1977AAR)." le 2.3, On page 6 at subparagraph 2.1.3,. place an asterisk, and at the bottom of the page endorse the following words: '"*Subparagraph 2.1.3 amended.' Rodondi City Clerk EXHIBIT "A" TO RESOLUTION 175-77 ADOPTED October 5, 1977 _ AMENDMENT 2-77 MEMORANDUM OF UNDERSTANDING, UNIT 6- INTERNATIONAL ASSOCIATION OF FIREFIGHTERS OF AMERICA, LOCAL 1507, AFL-CIO JULY 1, 1976- JUNE 30, 1978 Except for Surviving Provisions RECITALS THE CITY OF SOUTH SAN FRANCISCO (hereinafter City),and Unit 6 - International Association of Firefighte~s of America, Local 1507, AFL-CIO (hereinafter Unit 6), on August 30, 1976, executed a Memorandum of Under- standing entitled "Memorandum of Understanding, Unit 6, Internatio. na] Association of Firefighters of AmeriCal, Local 1507, AFL-CIO, July 1, 1976 - June 30, 1978, Except for Surviving Provisions", (hereinafter M/U 76-78), which was accepted and approved by Resolution No. 132-76 on September 15,. 1976. M/U 76-78 PROVIDED for the establishment of a New Base Salary for fiscal year 1977-78 to be effective on June 24, 1977, and additional matters set forth in said Memorandum of Understanding. A PERS ACTUARIAL VALUATION was recited in said Memorandum of Under- standing as one of the factors to be used in computing the New Base Salary. The Actuarial Valuation was not received as of June 22, 1977, and there- fore the parties to said Memorandum of Understanding on June 22, 1977, executed Amendment 1-77 (hereinafter Amendment 1-77) to M/U 76-78, which was approved and accepted by Resolution 99-77, adopted June 22, 1977, 1. I II lllll II ? - fol 1 ows: 2.1.1 Establishment of New Base Salary. In 1977-78 a New Base Salary for Firemen. represented by Unit6 is hereby established, same to be effective on . . Novembe.~ 21, 1977 . Said New Base Salary shall be computed as follows: {1) Add to each said firemen's 1976-77 bi-weekly salary range 6.5% thereof, which is the annual percentage change in cost of living as reflected in the bay area cost of living index for the preceding completed annual index period (April 1976 - April 1977}, and {2) then deduct from that total 7.44%. thereof,' said percentage being the difference between the City's total compensation cost for the ½ @ Age 55 Retirement Formula and the 2% @ Age 50 Retirement Formula for public safety members {police and fi re). m'~'(' ' Modification of Subpa. ra,qraph .2.1.2{c) of M/U 76/78. Subparagraph 2.1.2{c) of M/U 76-78 is herjby amended to read' as 2.1.2(c) The Base Salary or Amended Base Salary, whic'h~ever is applicable, results in a comparison difference between said salary and the salaries of other departments as well as the salaries of firemen in comparable agencies. If said comparison differenJe equals or is less than 7.44%, it shall not serve as the sole basis for negotiations related .to salary benefits or other terms and conditions of employment or increases or a~Ijust- ments to equal or approximate salaries, benefits or other terms 3~ follows- 4~ follows' and conditions of employment for other City departments or comparable agencies, or to otherwise increase said salaries. If the comparison difference equals or is less than 7.44%, City may refuse to consider same as a basis for increasi'~g the Base'Salary or Amended Base Salary and said refusal shall not be deemed a refusal to meet and confer in good faith or otherwise violative of the Meyers-Milias-Brown Act (Government Code Section 3500 et seq.) Amendment of Subl)ara~raph 2.1.3 .of M/U 76-78] Subparagraph 2.1.3 of M/U 76-78 is hereby amended to read as ., 2.1.3 Assurances by Firemen Not Members of ~Units 1 or 6. In addition to the acceptance and approval of paragraph 1 and the subparagraphs thereof of this Memorandum of Under- standing by vote of the membership, each fireman who is not repre- sented by Units 1 or 6 shall subscribe the acceptance and assur- ance to be attached hereto as Exhibit "A" and incorporated herein by this reference as if set forth verbatim. Firemen appointed after the effective date of this Memorandum of Understanding shall subscribe to a similar acceptance and assurance as a term and condition of employment. Amendment of Subparagraph 2.3(b) of M/U 76-78. Subparagraph 2.3(b) of M/U 76-78 is hereby amended to read as 2,3(b) All of of the public safety PERS members, who are not re- presented by Units I or 6 have executed a similar acceptance and assurance and same has been attached as Exhibit "A" to their Memorandum of Understanding. 5. Payment of Cost of Livin.q Adjustment 1977-78 for period prior to Establishment of New Base Salary. In accordance with M/U 76-78, June 24, 1977, was set as the date for application of the 6.5% cost of living adjustment to said firemen's 1976- 77 Base Pay and computation of the New Base Salary as therein provided. 'City and Unit 6, pursuant to Amendment 1-77, deferred payment of said adjust- ment and said computation. The New Base salary having been computed and the date for establishment having been determined, the parties agree that . each said fireman shall receive 6.5% of the total salary paid at the 1976- 77 rate between June 24, 1977 and the effective date of the New Base Salary, applying said percentage as same is....applied to salary ranges. Payment shall be made on or before December 29, 1977. 6. Effect of this Amendment. Except as herein provided, this Amendment 2-77 does not modify or change any other provision of M/U 76-78. IN WITNESS WHEREOF, the parties, hereto have executed this Amendment 2-77 in the City of South San Francisco on the 5th. day of (7~tober , 1977.
