CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION SUBMITTING TO THE CALIFORNIA REGIONAL
WATER QUALITY CONTROL BOARD THE COMPLIANCE SCHEDULES
FOR LEACHATE CONTROL AT OYSTER POINT MARINA AND
AUTHORIZING EXECUTION-OF ENGINEERING DESIGN AGREEMENT.
WHEREAS, the California Regional Water Quality Control Board in
a letter dated September 16, 1977, required the City of South San
Francisco to submit on or before October 25., 1977, Schedules for the
necessary corrective aCtions to be undertaken at Oyster Point Marina in
the form of a resolution adopted by the City Council~ and
WHEREAS, the City Council of the City of 'South San Francisco has
developed such Schedules entitled "Alternate Compliance Schedules Leachate
Control Corrective Actions at Oyster Point Marina," prepared by Daniel,
Mann, Johnson & Mendenhall, a corporation, Consulting Engineers (herein-
after DMJM), dated October 12, 1977, Job No. 6213-2-1; and
WHEREAS, said Schedules set forth alternate proposals for commence-
ment and completion of the leachate design and construction conditioned on
proceeding by way of (1) a Joint Powers Agreement with the San Mateo County
Harbor District, or (2) an election; and
WHEREAS, the City Council has received an Agreement from DMJM for
design of the leachate improvement work, and the Council desires to execute
the Agreement and provide that the leachate design work will proceed under
any of the alternatives accepted by the City Council of the City of South
San Francisco; f
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
South San Francisco that:

1. Compliance Schedules.
The Compliance Schedules entitled "Alternate Compliance Sched-
ules Leachate Control Corrective Actions at Oyster' Point Marina", prepared
by DMJM, dated October 12, 1977, Job No.-6213-2-1,are hereby approved for
submittal to the California Water Regional Quality Control Board. A copy
of said Schedules is attached hereto as Exhibit "A" and by this reference
incorporated herein.
2. Leachate Design A~qreement.
The Agreement entitled "An Agreement, Consulting Engineering
Services in Connection with Leachate Control Measures at the Inactive
Municipal Dump Site of City (Oyster Point Marina area)" between DMJM and
the City of South San Francisco.a municipal corporation, authorizing the
design of the leachate improvement work, is hereby authorized, and the
City Manager is authorized to execute said Agreement on behalf of the City
and the City Clerk attest his signature thereto. Said Agreement shall
contain a paragraph which, reads substantially as follows-
City and DMJM acknowledge that City and San Mateo
County Harbor District contemplate execution of
a new ~Joint Powers Agreement pursuant to which
District Will contract for the Oyster Point
Marina project engineering, including the leachate
design work. If said Joint Powers Agreement is
executed, DMJM shall pursue leachate design work
as part of the project engineering services in
lieu of proceeding pursuant to this Agreement.
If said Joint 'Powers Agreement is not executed, and the Oyster Point Marina
project is not pursued, City shall appropriate the necessary funds for the
leachate engineering design work and construction of leachate improvements.
3. Submittal to~ California Re.qional Water Quality Control Board.
The City Clerk be and he is hereby authorized to submit a
certified copy of this' Resolution to the' California Regional Water Quality
Control Board in accordance with said Agency's letter of September 16,
1977.
I hereby certify that the foregoing Resolution was regularly intro-
duced and adopted by the City Council of the City of South San Francisco
at a regular meeting held on the 19th day of October
1977, by the following vote'
