CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AUTHORIZING EXECUTION
OF A JOINT POWERS AGREEMENT WITH
THE SAN MATEO COUNTY HARBOR DISTRICT
AND RESCINDING PREVIOUS ACTIONS.
WHEREAS, the City of South San Francisco has been working toward the
improvement of Oyster Point to upgrade its limited facilities including
work to meet Regional Water Quality Control Board standards as set for'th
in the Judgment Granting Permanent Injunction and Ordering the Payment of
Civil Liabilities in People of the State of California v. City of South
San Francisco, et al, SF 633084, dated July 30, 1974, and to provide
improved recreational facilities, and
WHEREAS, City and the State Department of Navigation and Ocean Develop-
ment, hereinafter called DNOD, entered into an agreement dated September 8,
1975, providing for design, construction, funding, operation and other
factors related to rehabilitation of the existing marina basin and land-
side facilities and the construction of a second marina basin at the Oyster
Point. Marina in the City of South San Francisco, which is designate.d as the
"Project" in said agreement, and
WHEREAS, City, in accordance With Resolution 81-77 adopted June 15,
1977, entered into agreements with the following to implement said Project:
(1) the San Mateo County Harbor District, and (2) Daniel, Mann, Johnson &
Mendenhall, a corporation, for consulting services, and
WHEREAS, the CitY now desires to rescind Resolution 81-77 adopted
June 15, 1977, and the following agreements thereby authorized: (1) a
Joint pOWers Agreement with the San Mateo County Harbor District and (2)
an Agreement for Consulting Services With Daniel, Mann, Johnson & Mendenhall,
a corporation, and
WHEREAS, the City and Harbor District now desire to execute a new
Joint Powers Agreement to implement the Project which provides, in addi-
tion to other matters therein contained, that the Harbor District will
rehabilitate, manage, maintain and operate'the existing marina at Oyster
Point and const~ruct, manage, maintain and operate the future marina to
be developed at Oyster Point, and
WHEREAS, the Oyster Point Marina does provide regional recreational
opportunities which justify regional financial support;
NOW, THEREFORE, BE IT' RESOLVED by the City Council of the City of
South San Francisco that'
1. Rescission of Resolution 81-77 and Related Acts. When the San
Mateo County Harbor District and Daniel, Mann, JohnSon & Mendenhall, a
corporation, execute a contract substantially similar to the agreement
dated June 15, 1977, entitled, "An'Agreement with Daniel, Mann, Johnson &
Mendenhall, a Corporation, for Consulting Services'Related to Oyster POint
Marina/Park and' Task Order, Proposed Design - OPM Park Phases I and II,
DMJM Job No. 6213-2-1," then Resolution 81-77, adopted June 15, 1977, and
the following~ agreements thereby'authorized shall stand rescinded: (1)
'Doint Powers Agreement Between the San Mateo County Harbor District and
City of South San Francisco," dated July 6, 1977, executed on July 13,
1977, by the City of South San Francisco and on July 6, 1977, by the San
Mateo County Harbor District; (2)'mn Agreement with Daniel, Mann, Johnson
& Mendenhall, a Corporation, for Consulting Services Related to Oyster
Point Marina;' dated July 13, 1977; and (3)'Task Order Proposal - Oyster
Point Marina/Park, Phases I and II, DMJM Job No. 6213-2-1;' executed. July 13,
1977.

2. Execution of New Joint Powers Agreement~ Upon approval of the
following-described agreement by DNOD and execution of same by the San
Mateo County Harbor District, the City Council~authorizes execution of the
agreement entitled "Joint Powers Agreement, San Mateo County Harbor Dis-
trict and the City of South San Francisco," which, in addition to other
matters therein contained, provides that said District will rehabilitate,
manage, maintain and operate the existing marina at Oyster Point and con-
struct, manage, maintain and operate the future marina to be developed at
Oyster Point on the terms and provisions set forth.
3. Signatures. The City Managerbe and he is hereby authorized to
execute said agreement on behalf of the City and City Clerk attest his sig-
nature thereto.
I hereby certify that the foregoing Resolution was regularly intro-
duced and adopted by the City Council of the City of South San Francisco
at a regular meeting held on the 19th day of October
1977, by the following vote:
