HomeMy WebLinkAboutReso 223-1977WJML: JLC: c~ 11/30/77 Z~ RESOLUTION NO. 223-77 A RESOLUTION ORDERING AND CALLING A SPECIAL MUNICIPAL ELECTION TO BE HELD ON MARCH 7, 1978 FOR THE PURPOSE OF SUBMITTING TO THE VOTERS A PROPOSITION AUTHORIZING THE LEVY OF A SPECIAL PROPERTY TAX WITHIN THE CITY OF SOUTH SAN FRANCISCO AND ORDERING ITS CONSOLIDATION WITH THE GENERAL MUNICIPAL ELECTION TO BE HELD ON THE SAME DATE BE IT RESOLVED by the City Council of the City of South San Francisco, S~n Mateo County, California, that: 1. Pursuant to the provisions of Article 6, Chapter 3, Part 4, Division 1, (commencing at Section 2285) of the Revenue and Taxation Code, a special municipal election is hereby called and ordered to be held in the City of South San Francisco on Tuesday, the 7th day of March, 1978, for the purpose of sub- mitting to the qualified voters of said City the following proposition, to wit: PROPOSITION: "Shall the City Council of the City of South San Francisco be authorized to levy a special property tax of not to exceed a maximum annual rate. of five cents ($0.05) per One Hundred DOllars ($100.00) of as- sessed valuation of all taxable property within the City, in addition to the maximum annual property tax rate now authorized to be levied in the City, for the purpose of making lease Payments to a non-profit corporation for the use of, and for the ultimate acquisition of, the Value Giant property located at the corner of E1 Camino Real and Arroyo Drive as a police and other municipal purpose facility; said special property tax to terminate not later than June 30, 19987" -1- 2. The special municipal election shall be held and conducted, the votes thereof canvassed, the returns thereof made, and result thereof ascertained and determined as herein provided, and in all particulars not prescribed by this Resolution said election shall be held as provided by law for the holding of municipal elections in general law cities. 3. Said special municipal election is hereby ordered consolidated with the general municipal election which will be held within the City of South San Francisco on Tuesday, the 7th day of March, 1978. The special municipal election shall be held in the manner provided for the general municipal elec- tion, and the election precincts, polling places, and officers of election shall be the same as those set forth in the notice of election officers and polling places, proposed to be pub- lished in the Enterprise Journal no later than on February 15, 1978. 4. The elections hereby consolidated shall be held in all respects as if there were only one election, and only one form of ballot shall be used. 5. All persons qualified to vote at municipal elections in said City upon the date of the election herein provided for shall be qualified to vote upon the proposition submitted at said special' municipal election. 6. Ballots for said election shall be provided of the form and to the number provided by law. On said ballots, in addition to any other printed matter which may be required by law, two voting spaces shall be set off to the right of the proposition submitted at the election, in the manner .provided -2- by law, one having the word "YES" printed before it and the other having the word "NO" printed before it. 7. Each voter to vote for the proposition hereby sub- mitted shall mark in the prescribed' manner the voting space provided opposite the word "YES" on the ballot to the right of the propositiOn, and to vote against the proposition shall mark in the prescribed' manner the voting space provided oppo- site the word "NO" on the ballot to the right of the proposition. 8. If, at said election, it shall appear that a majority of the votes cast on the proposition were in favor of the proposition and in favor of authorizing the levy of the special property tax stated therein, then said proposition shall be deemed to be accepted and approved by the qualified vOters. 9. The polls shall be opened at 7:00 o'clock a.m. of the day of the election and shall be kept open until 8:00 o'clock p.m. of the same day, when the polls shall be closed, except as to voters in line as provided in Section 14301 of the Elections Code. 10. The Board of Supervisors of the County of San Mateo is hereby authorized to canvass the returns of the said special municipal election or to order such canvass to be made by the County Clerk pursuant to law. 11. The City Clerk is hereby~ authorized to procure all supplies and make all arrangements necessary for the proper conduct of said election. 12. Notice of Election, .in the form attached hereto and made a part hereof, shall be published once in SPanish and English in the Enterprise Journal, a newspaper of general cir- culation published and circulated within the City. Said publication shall be made no later than December 29, 1977. . . . . . . * -3~ . . . . . . . Mirri and Leo Padreddii None ABSENT, COUNCILMEMBERS None ATTEST: City Clerk EXHIBIT "A" NOTICE AND PROCLAMATION OF SPECIAL MUNICIPAL ELECTION CITY OF SOUTH SAN FRANCISCO NOTICE AND PROCLAMATION ARE HEREBY GIVEN AND MADE by the City Council of the City of South San Francisco, San Mateo County, California, that a special municipal election has been called and will be held on Tuesday, the 7th day of March, 1978, for the purpose of submitting to the qualified voters of said City the following proposition- PROPOSITION: "Shall the City Council of the City of South San Francisco be authorized to levy a special property tax of not to exceed a maximum annual rate of five cents ($0.05) per One Hundred Dollars ($100.00) of as- sessed valuation of all taxable property within the City, in addition to the maximum annual property tax rate now authorized to be levied in the City, for the purpose of making lease payments to a.non-profit corporation for the use of, and for the ultimate acquisition of, the Value Giant property located at the corner of E1 Camino Real and Arroyo Drive as a police and other municipal purpose facility; said special property tax to terminate not later than June 30, 19987" NOTICE IS FURTHER GIVEN that the polls shall be opened at 7:00 a.m, and shall be kept open until 8:00 p.m. of said day when the polls shall be closed, except aS otherwise provided in Section 14301 of the Elections Code.
