RESOLUTION NO. 8~ -78

A RESOLUTION ORDERING CHANGES AND MODIFICATIONS
AND CALLING FOR SEALED PROPOSALS AND FIXING
LIQUIDATED DAMAGES FOR FAILURE TO COMPLETE
THE WORK WITHIN TIME SPECIFIED
GELLERT BOULEVARD EXTENSION PROJECT
ASSESSMENT DISTRICT
PHASE II -- STREET IMPROVEMENTS
PROJECT NO. ST.77-5A
RESOLVED, by the City Council of the CitY of South San
Francisco, California, that
WHEREAS,. the said Council did, on the 4th day of May, 1977,.
adopt its Resolution of Intention No. 52-77 to order, among
other things, the construction of base, pavement, wearing surface,
curbs, gutters, sidewalks, street lighting facilities, divider
section, water mains, hydrants, services, fire alarm systems,
sanitary sewer mains, manholes, wye branches, laterals, traffic
signalization facilities, storm'drainage pipes, catch basins, and
underground utility duct systems, together with appurtenances to
any of the-above, all as more particularly described and set
forth in said Resolution of Intention, as amended; and
WHEREAS, a Petition and Consent executed by all of the
'owner~ o£ all of the property within the a~sessment district has
been filed with the City Clerk requesting that the acquisitions
to be made and the work to be done pursuant to said Resolution of
Intention be changed and modified so that construction Phase II
thereof conforms to those certain plans and specifications
entitled," Phase II Street Improvement Plans, Pro~ect No. ST 77-5A,
Gellert Boulevard Extension Project Assessment District", dated
July, 1978;
NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED as
follows:
1. The acquisitions to be made and the work to be done
pursuant to Resolution of Intention No. 52-77, as amended, and
the plans and specifications therefor are hereby'changed and
modified to conform, for construction Phase'II, thereof, to
those certain plans and specifications entitled, "Phase II
Street Improvement Plans, Project No. ST 77-5A, Gellert Boulevard
Extension Project Assessment District", prepared by Theodore V.
Tronoff, Civil Engineer & Surveyor, Inc., dated July, 1978, and
on file in the office of the City Clerk.
2. The maps and descriptions of the acquisitions to be made
pursuant to said Resolution of Intention are hereby ordered changed
and modified to conform to said plans hereinabove mentioned.
3. All of said changes and modifications shall be made by
the Engineer~either on the face of the report.or by filing an
amendment thereto.
4. The City Clerk is hereby directed to publish once a
week for two weeks in the Enterprise Jburnal, a newspaper
published and circulated in said City, a Notice Inviting Sealed
Proposals or Bids for the construction of said improvements,
and referring to the plans and specifications on file in the office
of said City Clerk, the first publication of which notice shall
be at least fourtegn days prior to the time fixed for opening bids.

5. Ail proposals or bids shall be accompanied by cash,
a cashier's or certified check payable to the order of the
City Clerk amounting to ten percent of the bid, or by a bond
in said amount and payable to said Clerk signed by the bidder
and a cOrporate surety or by the bidder and two sureties who ·
shall justify before any officer competent to administer an
oath, in'double said amount and over and above all statutory
exemptions. The amount so posted shall be forfeited to said
Clerk in Case the bidder depositing the same does not, within
fifteen days after written notice that the contract has been
awarded to him, enter into a contract with the City.
6. Pursuant to Section 1773 of the Labor Code of the
State of California, the City has obtained from the Director of
the Department of Industrial Relations the general prevailing
rate of per diem wages and the general prevailing rate for
holidays and overtime work for each craft, classification, or
type of workman required to execute the contract. A copy of
said prevailing rate of per diem wages is on file in the office
of the.City~Clerk, to which reference is hereby made for further
particulars. Said prevailing rate of per diem wages will be
made available to any interested party upon request', and a
copy thereof shall be posted at the job site.
7. It is hereby determined that in the event the contractor,
contracting owners included, does not complete the work within
the time limit specified in the proposed contract or within such
further time as this Council shall have authorized, the contractor
or contracting owners, as the case may be, shall pay to the City

liquidated damages in the amount of THREE HUNDRED DOLLARS ($300.00)
per day for each and every day's delay in finishing the work
beyond the completion date specified in said contract. Additional
provisions with regard to said time of completion and liquidated
damages are set forth in the specifications, which provisions are
hereby referred to and incorporated herein by reference.
8. Said sealed proposals or bids shall be delivered to the
City Clerk on'or before 2:00 o'clock P.M. on the 31st day of
July, 1978, said time being not less than fourteen daYs from the
time of first publication of said notice. Bids will be publiclY
opened, examined and declared on. said day and hour.
I hereby certify that the foregoing resolution was regularly
introduced and adopted by the City Council of the City of South
San Francisco at a regular meeting held this 5th day of
