HomeMy WebLinkAboutReso 89-1978 RESOLUTION NO. 89-78 CITY COUNCIL, CITY OF'SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A'RESOLUTION APPROVING WITH EXCEPTIONS REVERSION TO ACREAGE OF STONEGATE RIDGE CONDOMINIUM PROJECT NO. 3, ESTABLISHING CONDITIONS' OF REVERSION AND AUTHORIZING RELATED ACTS. WHEREAS, the "Stonegate Ridge Condominium Project No. 3" final map, dated May 1977 and recorded in San Mateo County Official Records on December 12, 1977, in Volume 96, pages 60 - 62, dedicated easements to the City of South San Francisco which were accepted by Resolution 200-77 adopted November 2, 1977, and WHE. REAS, Stonegate Properties, a Limited Partnership, and the City of South San Francisco entered into an agreement for subdivision improvements for said Stonegate Ridge Condominium Project No. 3 as of November 2, 1977, providing for improvement work withi~n~said easements, which agreement was recorded in San Mateo County Official Records on December 12, 1977, in Volume 7685, page 22, and WHEREAS, the City of South San Francisco and Stonegate Ridge ProPe~r- ties, a Limited Partnership, and Stonegate Ridge #3, a Joint Venture Project, entered into an Assumption Agreement as of July 5, 1978, providing that Stonegate Ridge #3, a Joint Venture, assume the obligations set forth in the subdivision agreement entered into as of November 2, 1977, and WHEREAS, all of the owners of Stonegate Ridge #3, a Joint Venture Project, petitioned the City of South San Francisco for approval of a reversion to acreage map entitled "Reversion to Acreage (Parcels I & 3, 'Stonegate Ridge Condominium Project No. 3,' South San Francisco~ California, Recorded in Volume 96 of Maps at Pages 60, 61 & 62, San Mateo County Records)," except for storm and sanitary sewer easements in, over, across and through Parcels A and B as dedicated by said Stonegate Ridge Condominium Project No. 3 final map, and WHEREAS, the City Council, after duly considering the reversion to acreage map on the 19th day of July , 1978 , at a regular City Council meeting at 'which all interested persons were heard, found that (a) except for the storm drain and sanitary sewer easements in, over, across and through Parcels A and B as dedicated by Stonegate Ridge Condo- minium Project No. 3 Final Map dated May 1977, recorded in Volume 96 of Maps, page 60, San Mateo County Records, other dedications or offers of dedications to be vacated or abandoned by the reversion to acreage are unnecessary for present or prospective public purposes, and (b) all owners of interest in the real property within the subdivision have consented to the reversion; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that: 1. Approval of Reversion to Acreage Map with Exceptions. The City Council hereby approves the map entitled "Reversion to Acreage (Parcels 1 & 3, 'Stonegate Ridge Condominium Project No. 3,' South San Francisco, California, Recorded in Volume 96 of Maps at Pages 60, 61 & 62, San Mateo County Records)~'dated May 1978, consisting of three sheets, excepting there- from the storm drain and sanitary sewer easements in, over, across and through Parcels A and B as dedicated by Stonegate Ridge Condominium Project No. 3 Final Map dated May 1977 recorded in Volume 96, page 60, San Mateo County Records. 2. Conditions of Reversion. The City Council orders (a) reten- tion of all previous paid fees to accomplish the purposes of Government Code Section 66499.11, et seq., and related City ordinances, and (b) reten- tion of improVement securities or deposits to accomplish the purpose of local ordinances adopted pursuant to said Government Code sections and the provisions of the "Agreement, Subdivision Improvements, Condominium Project No. 3," entered into as of the 2d of November, 1977, between the City of South San Francisco and Stonegate Properties, a'Limited Partnership, recorded in San Mateo County Official Records December 12, 1977, in Volume 7685, page 21, until obligors and their sureties file with City new improve- ment security deposits to replace those previously so filed. 3. Agreement for improvements. The City Council-hereby authorizes execution of an agreement between the City of South San Francisco and Stonegate Ridge #3, a Joint Venture, and its participating owners providing for the public improvements set forth in Exhibit A to the "Agreement for Subdivision Improvements for Stonegate Ridge Condominium Project No. 3" · . , dated November 2, 1977, recorded in San Mateo County Official Records on December 12,1977, Volume 7685, page 22. The Mayor is authorized to execute said agreement on behalf of the City, said execution to be attested by the City Clerk. 4. Filing and Recordation. The City Clerk be and she is hereby authorized to record or cause recordation of said final reversion to' acreage map in the Official Records of the County Of San Mateo concurrently with a certified copy of this resolution and the agreement providing for improvements. I hereby certify that the foregoing Resolution was regularly intro- duced and adopted by the City Council of the City of South San Francisco 3, at a regular meeting held on the 19th day of July, 1978, by the following vote' AYES' NOES- ABSENT' Councilmen Ronald G.
