CITY COUNCIL, CITY OF SOUTH' SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION RE' .ACQUISITION .OF ~325 MILLER
AVENUE' (SCHUMANN PROPERTY) .... ".'" '

WHEREAS, the City of South San Francisco desires to acquire a 'parcel
of improved property for public parking purposes to supplement existing-
parking facilities' and improvements proposed by the Downtown Revitilization
Project; and
WHEREAS, said propert~ is knoWn as 325 .Miller Avenue, consisting
of a lot approximately 50 x 140 feet with improvements thereon, designated
as Lot 20, Block 125, South San Francisco Plat No. I (recorded March 1,

1892, in Book 2 of Maps, Page 52, San Mateo County Records), ·which is
further identified as Assessors Parcel 12-312-06, hereinafter designated
"Property"; and
WHEREAS, the City obtained an appraisal of said property from Desmond
Johnson, M.A.I., which expressed an opinion that the market value of the
property is Seventy-Three ThOusand Five Hundred Dollars ($73,500); and
WHEREAS, the City proposed to the owner, Robert F. Schumann, of Turlock,
California, that City acquire said property for'Seventy-Three Thousand Five
Hundred Dollars ($73,500), and.the owner, on'October'30', 1978, accepted
City's proposal;
NOW, THEREFORE. BE IT RESOLVED by the City Council of the City of
South San Francisco that'
1. Authorization, to_ Ac, quire.~
The City Council hereby'ratifies the'Offer to Purchase Real
Property dated October 23',' 1978, and accepted OctOber 30',· 1978, and

authorizes the payment of Seventy-Three ThouSand Five Hundred Dollars
($73,500) for the acquisition of the property upon the following terms and
conditions hereinafter set forth.'
2. Terms- and. COnditions~

2.1. Depos.i t" Of'~ Acqui s.i tion' PPi ce.
The City shall deposit thelacquisition price of Seventy- ...
Three Thousand Five Hundred Dollars ($73,500) in escrow with the Title
Insurance and Trust Company, Redwood City, California, on or before November
29, 1978, and said purchase price shall be charged to Account No.
21-4519-768-85 in the Capital Improvement Fund.
2.2. COndition of.'Title.

Title shall-be in such condition as to support the issuance
of a standard CLTA policy therefor and shall be free 'and clear of all liens,
encumbrances, unpaid taxes, sewer service charges and other i liens collected
through the office of the San Mateo County Tax Collector, except the taxes
for the current year shall be pro-rated as of the date of the close of
escrow.
2.3. Grant Deed.
The owner shall deposit a grant deed to the City of South
San Francisco with Title Insurance and Trust Company, Redwood City, California,
within ten (10)' days after deposit of the purchase pri.ce, and deliver posses-
sion of the .property to the City within ten (10) days after close of escrow.
2.4. ' COSts.
The~.City'of South San Francisco and the'owner shall.each
bear one-half (½) of the'escrow cost. "The' City shall bear the recording
cost and cost of a standard CLTA policy. The Ownershall be responsible
'for any~ real estate broker's commissions or attorneys' fees, if same are
applicable.
2. Certificate' of .' AcCeptance.

The City.Clerk is authorized to execute and.· record a Certi~ficate
of Acceptance of the-grant deed to the property.
4. Escrow. InSr:uCtions..
The City Clerk and City Attorney'are authorized to issue escrow
instructions to carry out th~ provisions of this Resolution.
I hereby certify that the' foregoing Resolution was regularly intro-
duced and adopted by the City Council of the City of South San Francisco
at a regular meeting held on the'l'5th day of' NOvember ,
