HomeMy WebLinkAboutReso 169-1978 RESOLUTION NO. 169-78 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ~DECLARING OPPOSITION TO MANDATED COSTS BY'THE STATE WHEREAS, the concept of state compensation for mandated costs was a key provision in Senate Bill 90 which became effective on January 1,1973; and WHEREAS, this bill also established property tax limitations on cities, counties, special districts and school districts; and WHEREAS, this bill did nothing in regard to the then existing state mandated costs imposed upon ~cities, counties, special districts and school districts; and. WHEREAS, by the use of an extensive list of "disclaimers" became a device for the evasion of the original SB 90's intent; and WHEREAS, SB 90 of 1977 reflected the need for additional legiSlative concern regarding compensation procedures,; and WHEREAS, legislative acts involving cities, counties, special districts and school districts invariably impose additional costs; and WHEREAS, state mandated costs imposed on local governments are in fact a form of restrictions on the use of locally generated funds; and WHEREAS, recent constitutional amendments have imposed new property tax limitations on cities, counties, special districts and school districts; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco as follows' A. A rollback or complete abolition of previous state decisions le mandating actions or imposing cost incurring, regulations on local governments. ~ B. That this'rollback or abolition i'nclude all previous legislation that mandates costs on local governments. C. Any and all future legislation which mandates actions by cities, counties, special districts and school districts being paired with a revenue source other than those generated locally. D. Elimination of the extensive'list of "disclaimers" currently in use. BE IT FURTHER RESOLVED that the City Clerk of the City of South San Francisco shall and is hereby directed to forward copies of this Resolu- tion to the legislators of northern San Mateo County, State of California.
