HomeMy WebLinkAboutReso 3-19791187A JHHW:KIJ:pl 12/15/78 RESOLUTION NO. 3-79 A RESOLUTION APPOINTING ENGINEERS AND ATTORNEYS DOWNTOWN REVITALIZATION PROJECT NO. ST79-1 ASSESSMENT DISTRICT RESOLVED, by the City Council of the City of South San Francisco, County of San Mateo, California, that WHEREAS, this Council has determined to undertake proceedings pursuant to appropriate assessment and assessment bond acts for the acquisition and construction of public improvements; and WHEREAS, the public interest and convenience will be served by appointing and employing engineers and attorneys for the preparation and conduct of said proceedings; NOW, THEREFORE, IT IS ORDERED, as follows: 1. Robert S. M. Yee, City Engineer of the City, is appointed as Engineer of Work and directed to do and perform or cause to be done and performed all engineering work necessary in and for said proceedings, including the preparation of the requisite plans, specifications, maps and descriptions of easements, estimate of costs, diagram and assessment, the' cost of such work and services to be accounted for and assessed as an incidential expense of said proceedings. 2. The Engineer of Work is also directed to provide inspection of the construction of said improvements and to accept said work when it is satisfactorily completed. The cost of said inspection shall be assessed as an incidental expense of said proceedings. 3. That the law firm of Jones Hall Hill & White, San Francisco, ~'~'California, is appointed and employed to do and perform all legal services required in the conduct of said proceedings, including the preparation of all papers not required to be prepared by the Engineer, examining and approving the engineering documents and advising the Engineer in the preparation of his work, advising all officials of this City on all matters relating thereto when called upon, and furnishing their legal opinion on the validity of said proceedings and bonds; and that their compensation for such ~services is hereby fixed as follows, to wit: 2-1/2% of the total assessment, or $3,000, whichever is greater, together with reimbursement for out of pocket expenses incurred in connection with services rendered to City pursuant to this resolution limited to mean amounts paid for preparation of bond register and auditor's or treasurer's records, if any, and printing and mailing of notice of sale of bonds and official statement. 4. That said attorneys' fees be assessed as an incidental expense of the proceedings and be payable solely from the proceeds of assessments and sale of bonds and not otherwise. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on this 3rd day of ,lanmJ~r¥ , 19_/_~g, by the following vote' AYES, Counci lmembers: NOES, Counci lmembers' Ronald G.
