RESOLUTION NO. 40-79
A RESOLUTION AUTHORIZING IN REM VALIDATING PROCEEDINGS

DOWNTOWN REVITALIZATION PROJECT NO, ST-79-1
RESOLVED, by the City Council of the City of South San Francisco, San
Mateo County, California, that
WHEREAS, this Council has conducted proceedings under and pursuant to
Resolution No. 2-79, A Resolution of Intention to Make Improvements, adopted
January 3, 1979, in which proceedings this Council has confirmed and levied
special assessments on the parcels of land to be benefited by said
improvements;
WHEREAS, said proceedings are being conducted under and pursuant to the
Municipal Improvement Act of 1913, Division 12 of the Streets and Highways
Code of the State of California, except that bonds to represent unpaid assess-
ments are proposed to be issued in the manner provided by the Improvement Bond
-'- Act of 1915, Division 10 of said Code;
WHEREAS, Section lO601 of said Code provides that an action to determine
the validity of the assessment may be brought by this Council pursuant to
Chapter 9 (commencing with Section 860) of Title 10 of Part 2 of the Code of
Civil Procedure of the State of California;
NOW, THEREFORE, IT IS ORDERED that Jones Hall Hill & White, special bond
counsel for the City, are hereby authorized and directed to initiate and
prosecute to conclusion an' action under the above cited code sections to
determine the validity of said confirmed assessment, and to take such action
as may be necessary therein.
I hereby certify that the foregoing resolution was duly and regularly
adopted by the Council of the City of South San Francisco, at a regular
meeting thereof held on the 18th day of April , 1979, by the
following vote, to wit:
