A RESOLUTION AUTHORIZING EXECUTION OF AMENDMENT
TO AGREEMENT BETWEEN THE CITY OF SOUTH SAN
FRANCISCO AND THE STATE OF-CALIFORNIA (EL CAMINO
REAL WI DENING)

BE IT RESOLVED .by the City CoUncil of the City of South San
Francisco that:
1. EXecution:
Execution of the Amendment to Agreement between the City of
South San Francisco and the State of California, acting by and through its
Business and Transportation Agency, Department of Transportation (04-SM-82
20.8/22.1 04210-199121, Arroyo Drive to Hickey Boulevard, District Agreement
No. SM-41-3374), a copy of which is attached hereto as Exhibit "A", is
hereby authorized.
2. Signatures..
The Mayor is authorized to execute said Agreement on behalf
of the City, and the City Clerk' to attest his signature thereto.

THIS AMENDMENT TO AGREEMENT, MADE AND ENTERED INTO ON
DAY OF , 1979, BY AND BETWEEN
CITY OF SOUTH SAN FRANCISCO,
a body politic and a
municipal corporation of the
State of California,
hereinafter referred to as
"CITY"
STATE OF CALIFORNIA, acting
by and through its Business and
Transportation Agency,
Department of Transportation,
hereinafter referred to as
"STATE".
WITNESSETH:
WHEREAS, the parties hereto entered into an Agreement,
Document File No. SM-41-3374, which provides for widening
Route 82 (El Camino Real) between Arroyo Drive and Hickey
Boulevard (referred to as "PROJECT") and for constructing
sidewalks, curbs and gutters, landscaping, and installing
continuous lighting and traffic control signal systems
·
(referred to as "IMPROVEMENTS").

WHEREAS, bids for PROJECT and IMPROVEMENTS were opened
March 28, 1979. The low bid was 12 percent over the Engineer's
Estimate and almost all the increase over the Engineers Estimate
occurred in those items for which CITY is paying the matching
share; and
WHEREAS, the preliminary engineering effort required for
IMPROVEMENTS was comparable to that for PROJECT: and
WHEREAS, STATE's standardized rates for preliminary
engineering are applicable only to projects whose total cost is
under $2,000,000; and
WHEREAS, the lowest bid received by STATE for PROJECT and
IMPROVEMENTS was in the range of $3,200,000; and
WHEREAS, Agreement No. SM-41-3374 required that CITY pay
a rate of 8 % of the construction cost of IMPROVEMENTS for
preliminary engineering; and
WHEREAS, it has been determined that a rate of 5.67% of the
construction cost of IMPROVEMENTS for preliminary engineering
would be a more equitable rate for CITY to pay; and

WHEREAS, the parties hereto desire to amend said Agreement
tO account for the increased construction cost of IMPROVEMENTS
and for the lowered rate for ~preliminary engineering.
NOW THEREFORE, in consideration of the premises and mutual
understakings of the parties hereto, it is hereby agreed as
follow:
(1) That Section II, Article 1 and Exhibit A of the
aforesaid Agreement (Document File No. SM-41-3374) are hereby
superceeded and replaced by the following:

SECTION I I
CITY AGREES
1.) To deposit with STATE, with return of this Agreement
upon execution by CITY, the amount of $213,000 (or such portion
thereof which will increase CITY's deposit to $213,000) which
figure represents STATE's estimate of CITY's share for preliminary
engineering, construction engineering and construction costs for
the aforesaid IMPROVEMENTS pursuant to this Agreement. A
detailed estimate of CITY's share of these costs is shown on
Exhibit A-i' which by this reference is hereby made a part of
this Agreement. Actual costs to be borne by CITY will be
determined upon completion of all work and shall be the sum of
following:
(a) Construction Cost: CiTY's share (estimated to be
$145,000) shall be 50 percent of the cost to
· install traffic signals at Hickey Boulevard,
33 1/3 percent of the cost to install traffic
signals at the intersection of Route 82 and the
Kaiser Hospital entrance road and 100 percent of
the cost to construct sidewalks, curbs and gutters,
landscaping, and install continuous lighting after
expected FAU reimbursement has been deducted.
(b) Preliminary Engineering (Not FAU Participating):
CITY's share (estimated to be $48,000) shall be
5.67 percent of the CITY's share of construction

costs of IMPROVEMENTS before expected FAU
reimbursement has been deducted. Said percentage
includes payment for all applicable overhead
charges.
(c) Construction Engineering Costs CITY's share
(estimated to be $20,000) shall be 14 percent of
CITY's share of the construction cost of
IMPROVEMENTS after expected FAU reimbursement has
been deducted. 'Said percentage includes payment
for applicable overhead charges.

1 (2) All other terms and conditions of said original
2 .Agreement shall remain in full force and effect.

IN WITNESS WHEREOF, the parties hereto have caused this
Amendment to Agreement to be executed by their respective
officers, duly authorized, the provisions of which Agreement are
effective as of the day, month and year first hereinabove written.
