HomeMy WebLinkAboutReso 136-1979 RESOLUTION NO. 136-79 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING (1) A SUBDIVISION MAP FOR CONDOMINIUM PURPOSES(WILLOW AND GRAND CONDOMINIUMS), AND _(2) RELATED ACTS RECITALS A. RPD Permit 78-4. RPD Permit 78-4 Was conditionally approved by the Planning Commission on the 24th day of October, 1978, and by the City Council on the 6th day of December, 1979, with modifications of conditions. B. Tentative Map. A tentative Subdivision Map for Condominium Purposes (Willow and Grand Condominiums), referred to alternatively as (1)a Tentative Subdivision Map for Condominium Purposes, and (2) a site plan, was approved by the Planning Commission on the 24th day of October, 1978, and by the City Council on the 28th day of February, 1979, which tentative map proposed a subdivision to implement the phased development of RPD-78-4. C. Related Plans - Landscape Plans. Landscape plans and other related plans were conceptually approved by the Planning Commission on the 24th day of October, 1978, and tentatively by the City Council on the 28th day of February, 1979, with the proviso that said landscape plans would be presented to the Council concurrently with the final Subdivision Map for Condominium Purposes for final approval. D. Covenants and Restrictions. The developer's Declaration of Covenants and Restrictions to implement RDP-78-4 has been drafted and presented to the Division of Real Estate of the State of California, and a copy has been submitted to the City of South. · San Francisco. E. Subdivision Ordinance Variance. Ordinance No. 603, the Subdivision Ordinance of the City of South San Francisco provides for optional design and improvement standards, permitting variation of standards in areas where a planned unit development is being considered, particularly with respect to those shown on the site plan which was approved as part of the development proposal. F. Document Interrelationships and Purposes. RPD Permit 78-4, as amended, establishes a methodical program for the development of 21 parcels, requiring successive phase development of Phase 1 through 21 and providing for related improvements of common property correlated to phases. The SA-78-50 entitled, "A Subdivision. Map for Condominium Purposes (Willow and Grand Condominiums)," hereinafter designated Final Map, establishes 21 lots, each lot being equivalent to a phase and bearing the same number. The Declaration of Covenants and Restrictions, to be recorded concurrently with the Final Map, RPD-78-4, and the other related documents, provides for an orderly implementation of the development. G. Planning Commission Recommendation. The South San Francisco Planning Commission, in Resolution No. 2266 adopted November 19, 1979 entitled, "A Resolution Recommending Approval of a Subdivision Map for Condominium Purposes (Willow and Grand Condominiums) and Related Acts," reviewed and approved the map entitled, "A Subdivision Map for Condominium Purposes (Willow and Grand Condominiums)," consisting of three sheets, same being a subdivision of Parcels 1, 2 and 3 of the Parcel Map recorded at Book 43 of Parcel Maps at Page 17, Records of San Mateo County, California, City of South San Francisco, San Mateo County, prepared by e Dominguez and Associates, 3 South Linden Avenue, South San Francisco, California, ratified the variations with respect to lot divisions and other matters thereon set forth which were designed to implement RPD-78-4 and recommended certain actions to the City Council as in said resolution set forth. H. RPD Permit Amendment. The following described amendments to RPD Permit 78-4 have been added to said permit as Attachment A, bearing the approval and consent of owner/developer and reference to said amendments has been endorsed on the face of said permit. (1) Council ordered Amendments: Amendments ordered by the City Council on December 8, 1978. (2) Mandatory Annexation of Phases: An amendment requiring mandatory annexation of phases (parcels) to the DC&R's. (3) Construction Sequence Revision' An amendment describing modifica- tions of the construction sequence including completion of the parking lot portion of Parcel (phase) 21 prior to issuance of an Occupancy Permit for Phase 6 or by September l, 1980, whichever occurs first. I. Final Map Note. That the map entitled, "A Subdivision Map for Condominium Purposes (Willow and Grand Condominiums)," consisting of three sheets, same being a sub- division of Parcels 1, 2 and 3 of the Parcel Map recorded at Book 43 of Parcel Maps at Page 17, Records of San Mateo County, California, City of South San Francisco,.San Mateo County, prepared by Dominguez and Associates, 3 South Linden Avenue, South San Francisco, California, bears the following note on pages 2 and 3 thereof: NOTE' "The development of the parcels described on this map is regulated by the City of South San Francisco Residential Planned Development Permit No. 78-4, as amended, which is on file in the Office of the Department of Community Development. The Permit, in addition to other matters and conditions, provides for the sequential development of the parcels (described as phase development) commencing with Parcel (phase) 1 and proceeding in order through to Parcel (phase) 21, and correlated improvement work and/or facility construction with the phases." J. DC&R Amendment. That the DC&R's entitled, "The Willow/Grand Condominiums - Master Association," have been amended'to require that the approved landscape plans and as-built landscape plans, in accordance with the attachments to said DC&R's, be filed with the Association to be maintained in said records for. purposes recited in the DC&R's and reference and review by owners and prospective purchasers. K. Off-Site Improvements - Traffic Signals. That developers have submitted an Agreement providing for participation in the construction costs for traffic signals and securing performance as therein provided, which Agreement is entitled, "Agreement, Off-Site Improvements Related to a Subdivision Map for Condominiums (Willow and Grand Condominiums)." L. Pavement Approvement. That developers have filed with the City of South San Francisco an undertaking, secured in accordance with the terms thereof forPavement of 25' portion of the. easement area designated on the Final Map for ingress, egress and utilities. M. Landscape Plan Final Approval. That the landscape plans entitled, "Willow and Grand Condominiums Landscape Plan," prepared by Rosalyn Wheeler for Albert R. Seyranian, Architect and Associates, Job No. 7708, dated May 18, 1979 with Revisions, consisting of 0 Sheets L1 through L3 Planting Schedule, have been submitted to the City Council for final review and approval. N. Negative Declaration and Notice of Determination. That Council, on February 28, 1979, reviewed and considered Negative Declaration No. 159 and authorized recordation'thereof, and on December 5, 1979 again reviewed and considered Negative Declaration No. 159 and authorized filing of a Notice of Determination. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that: 1. Final Map Approval. The City Council reviewed and does hereby approve the map entitled, "A Subdivision Map for Condominium Purposes (Willow and Grand Condominiums)," consisting of three sheets, same being a subdivision of Parcels 1, 2 and 3 of the Parcel Map recorded at Book 43 of Parcel Maps at Page 17, Records of San Mateo County, California, City of South San Francisco, San Mateo County, prepared by Dominguez and Associates (R.C.E. 11435), 3 South Linden Avenue, South San Francisco, California, heretofore designated Final Map, and ratifies the variations with respect to lot divisions and other matters thereon set forth which were designed to implement RPD-78-4. 2. Landscape Plan Approval. The City Council has reviewed and does hereby approve the landscape plans described in paragraph M of the Recitals. 3. RPD Amendment Approval. The City Council hereby approves the RPD Permit amendments described in Recital H. Be 4. Execution of Agreement- Off-Site Improvements. The City Council authorizes execution of the Agreement entitled, "Agreement, Off-Site Improvements Related to a Subdivision Map for Condominiums (Willow and Grand Condominiums)," with the Mayor being authorized to execute said Agreement on behalf of the City, and the City Clerk attest his signature thereto. 5. Acceptance of Undertaking. The City Council accepts the undertaking to assure performance, related to RPD Permit 78-4, construction of a portion of the pavement for Willow and Grand Condominiums and authorizes the City Clerk, over her signature, to endorse thereon the following' "Accepted this 5th day of December , 1979, by the City Council pursuant to Resolution No. 136~79 ." 6. Recordation of Final Map,and Other Documents. The City Clerk is authorized to record or cause recordation of the Final Map in the official records of the County of San Mateo concurrently with the following: (a) This Resolution, (b) The Agreement for Off-Site Improvements Related to a Subdivision Map for Condominium Purposes (Willow and Grand Condominiums), and (c) The undertaking to assure performance related to RPD Permit 78-4 (construction of a portion of a pavement for Willow and Grand Condominiums), provided the developer records concurrently therewith the following' (1) Declaration of Convenants, Conditions and Restrictions of the Willow/Grand North Condominium Project, and (2) Declaration of Convenants, Conditions and Restrictions for the Community of Willow/Grand Condominiums - Master Association.
