CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION APPROVING DESTRUCTION OF
CERTAIN RECORDS OF THE CITY ATTORNEY'S
DEPARTMENT IN ACCORDANCE WITH GOVERNMENT
CODE SECTION 34090
WHEREAS, Government Code Section 34090, as amended by Statutes of
1975, Chapter 356, and interpreted by the Attorney General of the State of
California in 57 OAG 307, provides: "Unless otherwise provided by law, with
,,
the approval of the legislative body by resolution, the head of a city depart-
ment may destroy any city record, document, instrument, book or paper under his
charge without making a copy thereof, after the same is no longer required and
the department head has certified that the documents submitted for destruction
are more than five years old, are no longer required and none of the documents
are within the exceptions set forth in Government Code Section 34090;" and
WHEREAS, the City Attorney has certified that the documents submitted
for destruction are more than five years old, are no longer required and none of
the documents are within the exceptions set forth in Government Code Section
34090.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
South San Francisco, that:
1. In accordance with Government Code Section 34090, as amended by
Statutes of 1975, Chapter 356, and based on the Certificate of the City Attorney
that said records are more than five (5) years old and no longer required, and
the City Attorney having issued the required certificate, the City Council hereby
approves for destruction of those records set forth on Exhibit "A" attached
hereto and by this reference incorporated herein as if set forth verbatim.
I hereby certify that the foregoing Resolution was regularly
introduced and adopted by the City Council of the City of South San Francisco
at a regular meeting held on the 5~ day of March
1980, by the following vote:
AYES: Cl~uncilmen Ronald G. Acosta, William A. Borba, Emanuele N. Damonte,
Terry 3. Mirri; and Councilwoman Roberta Cerri Teglia

OF THE CITY ATTORNEY CERTIFIED FOR DESTRUCTION IN ACCORDANCE
WITH GOVERNMENT CODE SECTION 34090 AS AMENDED BY STATUTES OF
1975, CHAPTER 356
I, JOHN NOONAN, City Attorney of the City of South San Francisco,
CERTIFY that the following records, documents, instruments, books or papers
under my charge are more than five (5) years old, are no longer needed and
otherwise meet the requirements for destruction as provided in Government Code
Section 34090, as amended by Statutes of 1975, Chapter 356, and do consent to
the destruction of said records. I FURTHER CERTIFY that none of said records
(1) affect the title to real property or liens thereon, (2) are original court
records, (3) are records .r. equired to be kept by statute, (4) are records less
than five (5) years old, (5) are original minutes, ordinances or resolutions
of the legislative body or of a city board or commission.
Animal ordinance citations and related copies of correspondence, notices
of court dispositions and duplicate copies of ordinance provisions not
related to any pending actions.

This memorandum forwards copy of a proposed resolution to be scheduled 'for
Council agenda per your advice,
The resolution authorizes destruction of animal ordinance citations and
related correspondence more than five years old in accordance with Govern-
ment Code Section 34090. The original resolution has been forwarded to the
City Clerk together with her copy of this memorandum,
