CITY COUNCIL, CITY OF souTH SAN'FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION APPROVING THE APPLICATION FOR
GRANT FUNDS UNDER. THE STATE LITTER CONTROL,
RECYCLING AND RESOURCE RECOVERY FUND
WHEREAS, the Legislature of the State of California has enacted the
..

State Litter Control, Recycling and Resource Recovery Act which provides
·
funds'to certain entities for litter cleanup, litter law enforcement, litter
· .
education and purchase of litter receptacles'; and
WHEREAS, the State Solid Waste Management Board has been delegated the
responsibility for the administration of the program, setting up necessary
procedures governing application by 'local agencies 'under the program; and
WHEREAS, said procedures' established by the State Solid Waste Manage-
ment Board requires the applicant to certify the approval of applications.
prior to submission of said applications to the state; and
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of South
San Francisco: .

1. Approves the filing of. an application for funding under the State
Litter Control, Recycling and Resource Recovery Fund; and
2. Certifies that said agency understands the general provisions of
the grant agreement, a copy of which is'attached hereto as Exhibit "A"; and
3. Authorizes the __Dir... ~'~"Par~I and.Re'creation"as agent of the City
of South San Francisco to conduct all negotiations, execute and submit all
documents including but not limited to applications, grant agreements, amend-
ments and payment requests, which may be necessary for the completion of the
aforementioned program.
I hereby certify that the foregoing Resolution was regularly introduced
a~d adopted by the City Council of the City of South San Francisco at a
regular meeting held on the 7th day of May, 1980, by the following vote'

THIS AGREEMENT, entered into this 7th day of Hay , 140, by and

between the COUNTY OF SAN }DkTEO, a political subdivision of the State of California,
hereinafter called "County", and the CITY OF $o. S.F. , a (general law}
(charter) city of the County of San Mateo, State of California, hereinafter calleff
"City",
.wITNESSETH:

.~HEREAS, the State of California'and the County of San Hateo did on the
'~0thday of Hov..i9 78 enter into an agreement p~rsuant'to the Litter Control,
Recycling and Resources Recovery Act of 1977, Chapter 1, Division 7.8 of the

Government Code; and
WHEREAS, said agreement provides for the expenditure of $1,60~.00 for 'litter
control and cleanup in the City of So. S.F. ; and

I~HEP~EAS, the City of . $o. $.F. finds that it is in the public .interest ~.
to perform certain litter control and cleanup activities pursuant to said agreement;
and
~EREAS, the Board of Supervisors., by Resolution No. :

the Director of Public l~rks, as agent of t~e County~ to conduct all negotiations,
execute and submit all documents, including but not limited to applications,
grant agreements, amendments and payment requests, which may be necessary for the
completion of the aforementioned program~
MOW, THEREFORE, IT IS HEREBY AGREED BY THE PARTIES HERETO, that:
1. County agrees to (advance} (reimburse} City an amount not to exceed the'
sum of $ 1,60~.00
2. The attached Exhibit "A" lists the eligible items of work and/or
equipment pursuant to Paragraph 1 of this agreement.
3. City agrees to make all payments to employees, suppliers, or contractors
in connection with the items in Exhibit "A".

4. City agrees to furnish County with accounting records veri,.fytng
e.xpendit, u. res for the items indic,~ted in Exhibit "A". In the event the State
declares any items of work incurred by City as ineligible for funding, the costs
therefor shall be the responsibility of City.
5. City shall be responsible for and defend the County, its officers,
agents and employees from all claims, suits or actions of every name, kin~ and
description brought for, or on account of, i~juries or death of amy person or--
damage to property resulting from the performance of any work arising from a

6. In the event the State terminates the agreement with the-County for .... ;

any reason, County shall, have the right to termi~at~ this agreement upon fifteen
(15) days'written notice to the City. County S'fiall also have the right to t'ermima~e
this agreement immediately for failure of City to comply with the terms and con-
ditions of this agreement. In case of early termination, a final payment will be
·
made to City, subject to availability of project funds, upon receipt of a report
covering eligible costs incurred prior to the date of termination.
IN WITNESS WHEREOF, the parties hereto have caused this agreement'to be
executed by their duly authorized representatives on the day and year first above
set forth.
