PLANNING COMMISSION RESOLUTION NO. 2296 - ADOPTED THE llTH DAY OF JUNE,~.~.1981 WHEREAS, the proposed amendment (GP-81-15 ) to the City's General Plan is set forth in Resolution No. 2296 of the Planning Commission entitled "A Resolution of the Planning Commission of the City of South San Francisco reCommending that the City Council adopt GPA-81-15, an amendment to the Housing Element of the General Plan relating to Concominium, Stock Cooperative and Community Apartm6nt Conversions and approve Negative Declaration No. 322." attached hereto as Exhibit A, and WHEREAS, on the llth day of June , 1981 , by Resolution .~o~ 2296 the Planning Commission of the City of South San Francisco approved and recommended same to the Council, as set forth in Exhibit A attached hereto, and WHEREAS, the Council, 'pursuant to the Government Code of the §rate of California, duly set a hearing thereon for the 17th day of June · 19 81, notice of which was published in the "Enterprise-Journal," a newspaper of general circulation printed and circulated in the City of South San Francisco, and which date of publication was more than ten (10) days prior to the date set for said hearing, and the affidavit of said publication is on file in the office of the City Clerk, and WHEREAS, the Council did hold said hearing on said date and did there- upon consider said amendment and the statements and communications made at said hearing; NOW, THEREFORE, IT IS ORDERED THAT' 1. The Council hereby adopts as an amendment to the citY's'General Plan the'amendment recommended by the Planning Commission in Resolution No. ??96 , designated GP- 81-15 , as set forth in Exhibit A attached hereto, thereby amendi.ng the Housi.ng Element as therein desCribed. 2. The said amendment be endorsed as adopted by this Resolution and the Mayor and City Clerk shall execute said endorsement. hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 17th day of June , 19 by the following vote: AYES, COUNCILMEN Ronald G. That .the amendment v~uld not be adverse 'to the health, safety, ~ welfare, peace, morals or general ccmfort of persons residing or working in the community. -- 3. That the proposed amendment was consistent with applicable State Gover~ent Codes and General Plan Guidelines. 4. '~nat-a Negative' Declaration-was prepared in accordance with the California Enviror~nental' Quality 'Act 'of 1970, as kmended. NUN, THEREFORE, BE IT RESOLVED by the Planning (kxnmission of the City of South San Francisco that it hereby reccnrnends the City. The conversion of an apartment or multi-family housing'.project to a community housing project should not .be permitted until and unless the vacancy rate .for all multi-family .housing in the .Community exceeds three percent-(.3%). A-community housing project would include a condominium, stock co.operative, or community apartment project. Aside from the above noted vacancy factor the following other factors should be considered- before a conversion is permitted- a. A finding should.be made that a proposed conversion will-not have an overall negative effect on the.City's available housing stock, specifically the preservation of multi-family renl~al units. - b. Adequate .provisions have or wil'l be made' for the proper maintenance, management and 'budgeting of all conversion projects, - · c. All '~nversi°'n.projects 'should be made !to comply with all current City Codes and Ord~ances"including the Uniform Bbilding Code, the Fire, Mechanical,.Electfical. and Plumbing Codes, and ~che- .: Building Security,. Zoning, and Subdivision Ordinances. d. Prior' to the.approval of any conversions a determination should be made that,it is consistent with .goals,. objectives ~nd policies of th'e General Plan. ~ A condominium Conversion Ordinance should be adopted which incorporates the above policies and objectives and provides for'specific sta.ndards, fees, procedures and" requirement~ for review and consideration of any~-.~-~'e~-on application'. Relocation and other fees should be incorporated into the Ordinance to minimize the financial impact which a conversion will have on tenants and certain allow- ances should be made to provide long term tenancy privelages to elderly, handi- capped, low and moderate income persons in a project which is converted, -
