HomeMy WebLinkAboutReso 77-1981RESOLUTION NO. 77-81 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION CALLING FOR A SPECIAL ELECTION ON AN INITIATIVE MEASURE CONCERNING THE SOUTH SLOPE OF SAN BRUNO MOUNTAIN, TO BE SUBMITTED TO THE VOTERS OF THE CITY OF SOUTH SAN FRANCISCO WHEREAS, on July l, 1981, the City Clerk of the City of South San Francisco presented to the City Council of said City an initiative petition concerning the South Slope of San Bruno Mountain, entitled "Initiative Measure to be Submitted to the Voters of the City of South San Francisco," hereinafter referred to as "petition," a copy of which is attached hereto as Exhibit "A;" and WHEREAS, the petition contains a request for a special election; and WHEREAS, the City Clerk on June 24, 1981 certi, fied :that the petition was filed on June 15, 1981 by Jane Lee on behalf of the petitioners; and WHEREAS, the City Clerk further certified that the petition is suffi- cient, having the signatures thereon of more than fifteen percent (15%) of the registered voters of the City of South San Francisco; and WHEREAS, Section 4010 of the Elections Code requires that the City Council either introduce the ordinance without alteration at the regular meet- ing at which it is presented and adopt the ordinance within ten (10) days after it is presented; or immediately order a special election to be held not less than ninety-four (94) nor more than one hundred nine (109) days after the date of order, at which the ordinance, without alteration, shall be sub- mitted to a vote of the voters of the City. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco does hereby call for a special election to be held on Tues- day, October 6, 1981, for the purpose of presenting the measure submitted in the 1 petition to a vote by the people of the city of South San Francisco, and that the date of this order shall be reflected for all purposes as July 1, 1981. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized to procure all supplies and make all arrangements necessary for the proper con- duct of said election and is hereby directed to conduct said election in accordance with State law, including but not limited to the applicable por- tions of the Elections Code and Government Code. INITIATIVE MEASURE TO BE SUBMITTED DIRECTLY TO THE VOTERS OF THE CITY OF SOUTH SAN FRANCISCO PREAMBLE: Inasmuch as it is to the benefit of the citizens of the City of South San Francisco and surrounding communities (a) to have close access to open space in which to enjoy outdoor recreational activities; (b) to limit noise, traffic, and air pollution; (c) to prevent overcrowding of residences and businesses; (d) to maintain reasonable levels of personal privacy; (e) to preserve the aesthetic and scenic 'beauty of the region; and (f) to ensure that vital municipal services are not unduly burdened m and because there are presently available other areas, within and without the municipal boundaries of the City of South San Francisco, in which to house residential and business expansion and migration in 'a manner consistent with the goals set forth above -- the people of the'City of South San Francisco do ordain as follows: 1. The City of South San Francisco shall not supply any municipal service to all or any portion of the area commonly known as San Bruno Mountain unless the areas commonly known as San Bruno Mountain South Slope and Juncus Ravine are dedicated to parkland or open space for public use and enjoyment. 2. Nothing contained in this ordinance shall be construed to prevent the City of South San Francisco, in the event of an emergency declared by the City Manager of South San Francisco, from supplying temporarily any municipal se~wice -- including but not limited to police and fire protection m to all or any portion of the area commonly known as San Bruno Mountain. 3. Nothing contained in this ordinance shall be construed to obligate the City of South San Francisco to supply any municipal service to all or any portion of the area commonly known as San Bruno Mountain. 4. Nothing contained in this ordinance shall be construed to affect any law of the County of San Mateo, the State of California, or the United States, except insofar as to limit, according to the terms of Paragraph 1 of this ordinance, the .City of South San Francisco's participation in any land management plan or agreement with respect to all or any portion of the area commonly known as San Bruno Mountain. · 5. AS used vn this ordinance, the phrase "area commonly known as san Bruno Mountain" refers to the area designated as such in the United States Department of the Interior Geological Survey, San Francisco South Quadrangle, California 7.5 Minute Series, Topographic Map (1956). This area is page two (of four) approximately bounded as follows' (1) on the south, by the city limits of the cities of South San Francisco and Colma; (2) on the west, by the city limits of Daly City; (3) on the north, by the city limits of the City and County of San Francisco; and (4) on the east, by the Bayshore Highway. 6. As used in this ordinance, the phrase "areas commonly known as San Bruno Mountain South Slope and Juncus Ravine" refers to the portion of San Bruno Mountain bounded as follows: (1) on the south, by the city limits of the City of South San Francisco; (2) on the west, by the city limits of the City of Colma and the easement for electric power lines owned by Pacific Gas and Electric Company, recorded in san Mateo County Records, Volume 2421, page 330 (May 25, 1953), extending south to nortl~; (3) on the north, by the unimproved dirt Radio Road and jeep trail extending west to east along the ridge of San Bruno Mountain (as designated by the United States Department of the Interior Geological Survey, San Francisco South Quadrangle, California 7.5 Minute Series Topographic Map (1956)) until the eastern terminus of such trail, at which point the. northern boundary shall extend due east from the terminus to. the Bayshore Highway; and (4) on the east, by the Bayshore Highway. 7. The invalidation of any term or portion of this ordinance shall not have the effect of invalidating any other term or portion of this ~rdinance. 8. Unless we as citizens ensure that further urbanization and pa·sion are well-planned, such 8rowth could detrimentally affect the quality and ch·r- ter of our Uvea by creating un exce~dve physical ·nd financial burden on municipal services such as: (1) POLICE PROTECTION; (2) PARK & RECREATION FACILITIES; O) STORM DRAINAGE; (4) FIRE & PARAMEDIC SERVICES; (5) SEWAGE DISPOSAL: (6) TRAFFIC SAFETY & CONTROL. This Initiative provides a practical and effective way for the people of South San Francisco to control the disposition of our financial assets, to preserve and enhance the character of our City and the nellhboring region, and to protect the quality of our municipal services. /s/By: .lANE A.
