HomeMy WebLinkAboutReso 119-1981RESOLUTI ON NO. 119-81 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE COUNTY OF SAN MATEO FOR THE 1981-82 STREET RESURFACING PROGRAM that: BE IT RESOLVED by the City Council of the City of South San Franisco 1. Execution of Agreement. Execution of an Agreement entitled "Agreement Between the County of San Mateo and the City of South San Francisco for the 1981-82 Street Re- surfacing Program, is hereby authorized, and a copy of said Agreement is attached as Exhibit "1." 2. Signatures. The Mayor is authorized to execute said Agreement on behalf of the City, and the City Clerk attest his signature thereto. I hereby certify that the foregoing Resolution was regularly intro- duced and adopted by the City Council of the City of South San Francisco at a special meeting held on the. 30th day of September , 1981, by the following vote: AYES: Councilmembers Mar. k~.N. Acosta EXHIBIT "l" TO RESOLUTION NO. · ADOPTED AGREEMENT BETWEEN THE COUNTY OF SAN r,IATEO AND THE CITY OF SOUTH SAN FRANCISCO FOR THE 1981-82 STREET RESURFACING PROGRAM THIS AGREEMENT, entered into this day of''' , 1981, by and between the COUNTY OF SAN MATEO, a political subdivision of the State of California, hereinafter called "County", and the CITY OF SOUTH SAN FRANCISCO, a general law city of the County of San Mateo, State of California, hereinafter ca 11 ed "Ci ty", 'WITNESSETH: WHEREAS, Section 186.3 of the Streets and Highways Code provides that the expenditure o~ funds apportioned to a county pursuant to Section 2106 of said code for construction upon a city street which complements the streets of the County shall be deemed an expenditure upon the system of streets of the county making such expenditure; and WHEREAS, certain major street projects within the city are of areawide interest and benefit to the County of San Mateo as a whole; and WHEREAS, a contract will be let for the resurfacinq of various streets wi thin the City; and WHEREAS, the City of South San Francisco finds that the resurfacing of various public streets would be in the public interest: NOW, THEREFORE, IT IS HEREBY AGREED BY THE PARTIES HERETO, as follows: 1. City agrees to submit to the State Controller of the State of California all notices and reports required to make this project eliqible for expenditure of Section 2106 funds. · 2. County agr6es to reimburse City from Section 2106 monies of its road funds an amount equal to two-thirds (2/3) of the eligible City streets and various eligible roadway items of work not to exceed the sum of $117,700. 3. City agrees that all City/County Highway Program "B" Funds shall be utilized prior to City/County Highway Program "A" Funds. 4. City agrees that bids for said project must be opened no later than April 1, 1982.. 5. Attached Exhibit "A" lists the eligible City streets and various eligible roadway items of work within the city limits of City. 6. City agrees to make all payments to contractor for work completed in the construction of said improvements. 7. City s'hall furnish County with all documents requested by County in order to verify quantity calculations prior to City's seeking reimbursement for such costs under Paragraph 2 of this Agreement. 8. City will furnish the design engineering necessary for preparation of plans, specifications, and engineer's estimate for the entire project.. 9. City will furnish construction engineering, including surveying, neces- sary for the construction of the improvement for the entire project. 10. County agrees to make payments hereinabove provided for on a progress payment basis. The County will repay the City for County's pro-rata share of City's disbursement for eligible items after receipt from City of a certification of the progress payment made by City to contractor. 11. City agrees that said County aid, as herein provided, shall be used solely for design engineering, construction inspection and construction of said improvements hereinabove mentioned. e · 12. City agrees to furnish such reports and accounts of the' expenditure of such aid funds as County deems necessary and convenient. 13. City warrants that it will comply with all rules, regulations and laws of the State and Federal governments, including but not limited to Section 7260 et seq. of the Government Code and Public Law 91-646, and that County shall not be responsible for City's failure to so comply. Further, City shall hold County harmless from any failure by City to comply with all rules, regulations and laws of the State and Federal governments. 14. Said County being deemed a responsible agency shall be included in the environmental review process as discussed in the Guidelines for Implementation. of the California Environmental Quality Act (CEQA) of 1970. o 15. The City shall indemnify and save harmless the County, its officers, agents and employees from all claims, suits or actions of every name, kind and description brought for, or on account of, injuries to or death of any person or damage to property resultinQ from the performance of any work arising from a project financed, in whole or in part, with County funds as specified in this agreement.
