HomeMy WebLinkAboutReso 4-1982RESOLUTION NO. 4-82 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION DECLARING THE BUILDING AT 52 FRANKLIN AVENUE, SOUTH SAN FRANCISCO, CALIFORNIA, TO BE A PUBLIC NUISANCE WITH- IN A STREET RIGHT-OF-WAY AND AN IMMEDIATE HAZARD TO THE PUBLIC HEALTH AND SAFETY AND ORDERING THE ABATEMENT THEREOF. WHEREAS, there exists at 52 Franklin Avenue in the City of South San Francisco, a building which has slipped from its foundation and now lies within the public right-of-way of the street known as Franklin Avenue; and WHEREAS, said building has been found by the Building Inspector of this City to be an immediate hazard to the public health and safety; and WHEREAS, the above described hazard occurred as a result of a catastrophic rainstorm which caused much damage in the City of South San Francisco; and WHEREAS, this City Council has held a hearing concerning the condition of the affected premises, the estimated cost of abating the nuisance and other pertinent matters; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the following findings are made: 1. That the building located at 52 Franklin Avenue currently lies with- in the public right-of-way for Franklin Avenue creating an obstruction which interferes with the use of Franklin Avenue for public transit. 2. That said building is located in such a position and condition that it represents an immediate and serious threat to the public health and safety and is a public nuisance. 3. That the estimated cost of abating the nuisance is approximately .... $6,000.00. 4. That the public health, safety and welfare requires that the afore- mentioned structure be abated forthwith. BE IT FURTHER RESOLVED that the Building Inspector of this City is hereby instructed pursuant to Section 203 of the Uniform Building Code to insure that said nuisance is abated on or about Friday, January 8, 1982 or as soon thereafter as possible. BE IT FURTHER RESOLVED that, with respect to the expense involved in abating said nuisance, the Building Inspector shall comply with the provisions of Section 8.24.120 et seq. of the South San Francisco Municipal Code, including all notice provisions contained therein. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular ....... meeting held on the 6th day of January , 1982, by the following vote: AYES: Councilmembers Ronald G. Acosta, Mark N. Addiego, Emanuele N. Damonte, Gus Nicolopulos; and Roberta Cerri Teglia NOES: None ABSENT: None
