CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION OF INTENTION TO FORM AN
UNDERGROUND UTILITY DISTRICT, AND
CALLING FOR A PUBLIC HEARING TO DETER-
MINE WHETHER OR NOT THE PUBLIC HEALTH,
SAFETY OR WELFARE REQUIRES THE FORM-
~ATION~OFSAID'UNDERGROUND'UTILITY~DISTRICT
WHEREAS, Division 12 of the Streets and Highways Code, aPplicable
provisions of Division 7 of the Streets and Highways Code and Chapter 13.16
of the South San FranciscoMunicipal Code set~ forth the procedure for the crea-
tion of Underground Utility Districts; and
WHEREAS, the aforementioned laws require'as the initial step in such
procedure the adoption of a Resolution of Intention followed by the holding of
a Public-Hearing to ascertain whether the public necessity, health, safety or
welfare requires the removal of poles, overhead wires and associated overhead
structures, and the underground installation of wires and facilities for supply-
ing electric, communication, or similar or associated services in any such dis-
trict; and
WHEREAS, this Council has received a petition entitled, "~etition for
Proceedings for the Conversion of Existing Overhead Electric and Communication
Facilities to Underground Locations within the Proposed Gateway Underground
District pursuant to Special Assessment and Assessment Bond Acts, Adoption of
an Ordinance for the Creation of an Underground District Pursuant to Ordinance
No. 566, and Waiver of Proceedings under Division 4 of the California Streets
and Highways Code;" and
WHEREAS, this Council has also received a Certificate of Sufficiency
from the City Clerk as required by Section 5896.7 of the Streets and Highways
Code.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
South San Francisco that:
1. The City Council does hereby declare its intention to establish an
Underground Utility District entitled "The Gateway Underground Utility District,"
the boundaries of which district are more particularly described in Exhibit ',A"
hereto which is hereby adopted by reference as though set forth verbatim herein,
and to order the.conversion described in said petition.
2. NOTICE IS HEREBY GIVEN that a public hearing will be held by the
City Council of the City of South San Franciso.on July 7, 1982, at the hour
of 7:30 p.m. in the Community Room of the Municipal Services Building, 33 Arroyo
Drive, South San Francisco, California, 94080, to ascertain whether the public
necessity, health, safety or welfare requires the removal of poles, overhead
wires and associated overhead structures and the underground installation of
wires and facilities for supplying electric, communication, or similar associated
services in the District hereinabove described.
3. At such hearing all persons interested shall be given an opportunity
to be heard. Said hearing may be continued from time to time as may be deter-
mined by the City Council.
4. The City Clerk shall notify all affected property owners as shown
on the last equalized assessment roll and utilities concerned of the time and
place of such hearing by mailing a copy of this resolution to such property
ow~nlers and utilities concerned at least thirtY (30) days prior to the date ~thereof.
5. The City Clerk shall publish a Notice of Hearing once thirtY (30)
days prior to the date of the hearing in the Enterprise~Hournal, a newspaper
of general circulation, published and circulated regularly in the City of
South San Francisco.

I hereby certify that the foregoing Resolution was regularly introduced
and adopted by the City Council of the City of South San Francisco at a regular
meeting held on the 19th day of May , 1982, by the following
